الگوی رژیم پارلمانی در نظام مبتنی‌بر حاکمیت الهی و ولایت فقیه در جمهوری اسلامی ایران

نظام ولایت فقیه، منبعث از حاکمیت الهی و نظام پارلمانی مبتنی‌بر نقش پررنگ نمایندگان مردماست. اگرچه جمع این دو با مشکلاتی مواجه است، اما از آنجا که حاکمیت الهی از قدیمی‌ترین اشکال حاکمیت است و امروزه نیز بسیاری از مردم جهان دارای عقاید دینی‌اند، با ترکیب این نظریه با دستاوردهای خرد جمعی بشری می‌توان راهکار مناسبی برای حکومت‌های امروزی به‌دست داد. سوال پژوهش این است که مشخصات رژیم پارلمانی، در تشکیلات مبتنی‌بر حاکمیت الهی در جمهوری اسلامی ایران چیست؟ روش تحقیق در این پژوهش، توصیفی و تحلیلی است. براساس یافته‌های نوشتار حاضر، همان‌طورکه می‌توان به رژیم کنونی، نظام ولایی از نوع نیمه‌ریاستینیمه‌پارلمانی گفت، با ایجاد تغییراتی می‌توان آن را بومی و تبدیل به «رژیم پارلمانی ولایی» کرد که سازگاری بیشتری با حاکمیت الهی داشته باشد. در واقع با تفکیک وظایف شرعی از سایر وظایف ولایت فقیه و بازتعریف این «سایر وظایف» در راستای قوۀ تعدیل‌کننده و نیز استفاده از نظام نسبتاً حزبی نه تماماً حزبی، می‌توان شرایط را برای نظام پارلمانی فراهمکر.

The pattern of the parliamentary regime in a system based on divine sovereignty and Waliyat Faqih in the Islamic Republic of Iran

The Waliyat Faqih system is the stems out of divine sovereignty and the parliamentary system is based on the high role of the people’s representatives. So the combination of these two enounter problems. However, since divine sovereignty is one of the oldest forms of sovereignty, and today many people in the world have religious beliefs, the combination of this theory with the achievements of human wisdom a good solution for today’s governments could be achived. The question of the research is how can the balance and cooperation of power be achieved in the organization based on divine sovereignty in the Islamic Republic of Iran? The research method in this research is library method. Based on the findings of this study, the present regime is a special system that is not fully compliant with any of the categorizations. As it may be named as a Welai Syatem of  semipresidential, semiparliamentary system, it could be turned into a native "Welai parliamentary regime", which is more compatible with divine sovereignty. In fact, with the separation of the religious duties from other Waliyat Faqih duties, and the redefinition of these "other duties" for the moderator, as well as the use of a rather partial party system, not all parties, the conditions for the parliamentary system could be provided.
