شناسایی جمعی فلسطین؛ عضویت در سازمان ملل متحد

براساس اساسنامه‌های سازمان‌های بین‌المللی، پیش‌شرط عضویت در آن سازمان‌ها دولت بودن نهاد متقاضی است. براساس مادۀ 4 منشور ملل متحد، تنها دولت‌ها می‌توانند به عضویت سازمان ملل درآیند. زمانی‌که دولتی عضو سازمان ملل می‌شود، سایر دولت‌هایی که به آن رای مثبت داده‌اند، «دولت بودن» عضو جدید را تصدیق کرده و به‌نوعی آن را شناسایی می‌کنند. پس از تصویب قطعنامۀ 67.19 در مجمع عمومی سازمان ملل، جایگاه فلسطین به دولت ناظر غیرعضو ارتقا یافت. یکی از مباحث مهمی که اغلب پس از صدور قطعنامۀ اخیر مطرح شد، شناسایی جمعی فلسطین از مجرای مجمع عمومی سازمان ملل است. بدین‌معنا دولت‌هایی که به قطعنامۀ 67.19 رای مثبت دادند، به‌نوعی به شناسایی دولت فلسطین نیز پرداخته‌اند، چراکه با رای مثبت خود وجود دولت فلسطین را تصدیق کرده‌اند. به نظر نگارنده رای مثبت به عضویت یک دولت در سازمان‌های بین‌المللی به‌خصوص سازمان ملل به‌طور ضمنی شناسایی عضو جدید را در پی دارد. در مورد فلسطین نیز اگرچه به عضویت سازمان ملل درنیامده، در قطعنامۀ مذکور دولت بودن فلسطین تصدیق شده است که به‌طور ضمنی شناسایی دولت فلسطین از طریق مجمع عمومی سازمان ملل محسوب می‌شود.

Collective Recognition of Palestine, Membership in the United Nations

Generally,according to the statutes of international organizations,the precondition for membership in those organizations is that the applicant institution should be state.According to Article 4 of the United Nations Charter,only states can become members of the United Nations.When a State become a member of the United Nations,other states that have voted in favor of new member,acknowledge new member as a state and recognize it.After the adoption of resolution 19/67 by United Nations General Assembly, the status of Palestine was enhanced to nonmember observer state. One of the major issues that has generally been raised since the issuance of the recent resolution was the collective recognition of Palestine by the UN General Assembly.In this sense,the states that voted in favor of resolution 19/67 have also somehow recognized the Palestinian state because because with their positive pole acknowledge the existence of the Palestinian state.In the author's opinion,the vote in favor of membership of a state in international organizations,especially the United Nations,implicitly recognize a new member.In the case of Palestine, although it has not become a member of the United Nations,the resolution acknowledge Palestine as a state that implicitly lead to recognized Palestinian as a state through the General Assembly of the United Nations.
