تحلیلی بر مفهوم حق نظارت همگانی بر قدرت براساس دو رابطۀ حقادعا و حقآزادی

حق پاسداشت کرامت انسانی، استقلال و حق‌های بشری در جامعه، غلبۀ گفتمان حق در عرصۀ زمان کنونی است. حق تعیین سرنوشت به‌مثابۀ بنیان بسیاری از حق‌ها، اقتضا دارد تا توانش نظارت مستمر و تعقیب خط سیر قدرت را با هدف تحدید آن، در مرزهای حق‌ها و آزادی‌های بشری داشته باشد. روابط ناشی از حق نظارت همگانی بر قدرت همچون بسیاری از حق‌ها مناقشه‌برانگیز است. این امر ضرورت تبیین آن را با هدف منقح‌سازی ساحت حق از تحدیدهای غیرضرور و مخل و شفاف‌کردن محتوای حق‌ها که به‌وضوح تکالیف نیز می‌انجامد، مبرهن می‌کند. در پژوهش حاضر با تحلیلی اجمالی از مولفه‌های حاکم بر روابط دوگانۀ هوفلد و ارکان حق نظارت همگانی بر قدرت، قابلیت آن در بهره‌مندی از شیوۀ تمایزگذاری روابط و پردازش حق‌ها و تکالیف متفاوت به تصویر کشیده شده است. پیامد سنجش مزبور نشان از امکان بهره‌مندی از تحلیل رابطۀ قانونی یا موقعیت قانونی حقادعا و حقآزادی دارد.

Analysis of the Concept of Public Supervision on Power Based on Two Relation Claimright and Libertyright

The result of preserving the independence of dignity and human rights in society has caused right discourse is common at the present time. The right of Selfdetermination as the basis of many rights and freedoms requires in order that the one has power for Continuous monitoring and prosecution powers to limit it and guarantee the human rights and freedoms. Relation caused by the right of public oversight to power as many rights dispute. This different look requires the right of public oversight to power has been examined more. To determine the scope of necessary limitations of unnecessary restrictions. This would also make the content of right clear. In the present study component ruling on Hohfled’s bilateral relations and the elements of the right of public oversight to power will be analyzed. This attempt will be done to distinguish relations and rights and assignments. The result of this analysis shows that the analysis of legal relations and legal positions of claimright and libertyright can be used in analysis of right of public oversight to power.
