   جستاری نقادانه در باب کیفرهای بدنی در پرتو خوانشی کارکردگرایانه از ادله اربعه در جهان معاصر

چکیده    گرچه از دیدگاه مشهور فقهای اسلامی، کیفرهای بدنی در باب معاملات و موضوعات غیرعبادی می‌گنجد، ولی همواره نگاهی عبادت‌گونه بر آن‌ها، به‌ویژه بر حدود و قصاص، سایه افکنده است. بدین معنا که گویا آن‌ها توقیفی، دارای حقیقت شرعی، فرازمانی و فرامکانی‌اند. این نگاه در پرتو خوانشی کارکردگرایانه از ادله اربعه در جهان کنونی، بدون اشکال نیست. به سخن دیگر می‌توان با تکیه ‌بر «کتاب»، «سنت»، «اجماع» و «عقل» از چنین مجازات‌هایی در این زمانه گذر کرد. درباره «کتاب» می‌توان با بهره‌برداری از نگاه مقاصدی و رویکرد کارکردگرایانه در کیفرهای بدنی بازاندیشی کرد. نیز، نباید در بازخوانی «سنت» از تردید در سندیت روایات اجرای مجازات‌های بدنی به دست پیامبر (ص) غافل شد. همچنین، نباید برخورداری وی از نقش حاکم اسلامی و طبیعتاً صدور احکام مبتنی بر بایسته‌های اجتماعی سرزمین وحی را از یاد برد. افزون بر این، درباره اجماع، جدای از آنکه درستی انگاره اجماع در موضوعات اجتماعی - فرهنگی مانند مجازات، دست‌کم در روزگار کنونی، دشوار است، نباید از تاثیرپذیری فقهای گذشته از چندوچونی حاکم بر زمان صدور فتوا، به ‌سادگی رد شد. سرانجام، درباره «عقل»، نخست باید توجه داشت که این دلیل در کنارِ سه دلیل دیگر است نه در طول آن‌ها، بنابراین ارزش دستاوردهای عقلی کم از سه مورد دیگر نیست. دوم آنکه عقل موجودی ایستا نیست؛ بلکه پویا و کاشفِ خوبی و بدی‌هاست. در نتیجه چنانچه عقل بشر کیفرهای بدنی را برنتابد و بر پایان کارکرد آنها حکم نماید، شارع خردمند هم بر گونه‌های دیگر واکنش کیفری جامه مشروعیت می‌پوشاند.

   a critical research about corporal punishments in the light of a functionalist reading of adillah al-arba'ah (four sources in islamic law) in the contemporary world

Abstract    in the famous jurisprudence books of jurists، corporal punishments are mentioned in the mu'amalat. but these punishments، especially ḥudūd and qiṣāṣ، have always been treated like acts of worship. this means that they should be implemented at all times and places. this view is flawed in the light of a functionalist reading of adillah al-arba'ah (four sources in islamic law). qurʾān can be reconsidered by using the purposeful view and functionalist approach in corporal punishments. besides، in re-reading the sunnah، one should not neglect the authenticity of the narrations of the implementation of corporal punishment by the prophet (pbuh). in addition، we should not forget his role as an islamic ruler and naturally issuing rulings based on the social needs of the land of revelation. moreover، about al-ʾijmā، apart from the fact that it is difficult to imagine ijma' in socio-cultural issues such as punishment in the present day، the influence of past jurists on the conditions prevailing at the time of issuing the fatwa should not be simply rejected. finally، about 'aql، it should be noted that this reason is next to the other three reasons، not during them، so the value of intellectual achievements is not less than the other three. second، reason is not a static entity; rather، it is dynamic and a discoverer of good and bad. as a result، if the human mind does not accept physical punishments، god also covers this human decision with the cloak of legitimacy.
