اِکوساید (بوم زدایی): جنایتی علیه توسعه پایدار

بر مبنای آموزه توسعه پایدار، هر نسل بشری مکلّف است از منابعِ زمین به‌گونه‌ای بهره‌برداری نماید که ضمن تامین نیازهای خود (انصافِ درون‌نسلی)، به منابعِ لازم جهت تامین نیازهای نسل‌های آینده (انصافِ میان‌نسلی) آسیبی نرساند. در پرتو این آموزه نوپیدا، که به الگوی جهانی و مطلوبِ توسعه در جامعه بین‌المللی نیز تبدیل شده است، مفهومِ توسعه، معنا و گستره متفاوتی پیدا می‌کند؛ به‌این‌صورت‌که، افزون بر جنبه اقتصادی، توسعه، دو ساحتِ اجتماعی و ‌محیط‌زیستی نیز دارد. در این چهارچوبِ تحلیلی، اِکوساید را باید تهدید جدّی علیه توسعه پایدار دانست. زیرا، اِکوساید، محیط‌زیست و منابعِ طبیعیِ ملّت‌ها را به‌شدّت تخریب نموده و افزون بر تهدیدِ امنیّتِ ‌محیطزیستی، پایه‌های امنیّتِ اقتصادی و اجتماعی را نیز به لرزه درمی‌آورد. پیامدِ مستقیمِ اِکوساید، فروپاشیِ امنیّتِ اقتصادیِ جوامع است، که این امر به‌نوبه خود منجر به بروز یا گسترشِ بحران‌های اجتماعیِ شدیدی مانندِ فقر، بی‌کاری، بی‌خانمانی، بزه‌کاری، آوارگی، پناهندگی، درگیریِ قومی، مخاصمه مسلّحانه و ... نیز می‌گردد. ازاین‌روی، ضروری است که جرم‌انگاری آن در کانون توجّه نظام‌های حقوقیِ داخلی، منطقه‌ای و بین‌المللی قرار گرفته و سیاستِ جناییِ مشترکی در برابرِ آن اتّخاذ گردد تا از وقوع اِکوساید پیش‌گیری گردیده و به بی‌ترمیم‌مانیِ قربانیان و بی‌کیفرمانیِ مرتکبینِ آن پایان داده شود.

Ecocide: A Crime against Sustainable Development

According to “the Sustainable Development Doctrine”, it is incumbent on every human generation to use the earth resources in a manner that, while providing its own needs (intragenerational fairness), does not harm the resources needed for future generations (intergenerational fairness). In light of this new doctrine, which has also become a global and favorable model of development in the international community, the concept of development has a different meaning and scope, in that, development in addition to having an economic dimension, also pertains to social and environmental aspects. In this framework, ecocide is considered a serious threat to sustainable development. Ecocide severely degrades the environment and natural resources and shakes the foundations of economic and social security alongside threatening environmental security. The direct consequence of ecocide is the deterioration of economic security of society, which in turn results in or exacerbates severe social crises including poverty, illness, unemployment, homelessness, conflict, illiteracy, delinquency, immigration, displacement, asylum, ethnic clashes, armed conflicts, etc. It is therefore imperative that its criminalization be at the center of the attention of national, regional and international legal systems and that a common criminal policy be adopted to prevent the occurrence of ecocide and end the perpetrators’ wrongdoing.
