چالش مربوط به تفکیک تصمیمات موردی از تصمیمات عام الشمول اداره در رویه دیوان عدالت اداری

در ساختار و صلاحیت دیوان عدالت اداری، صلاحیت شعب و هیات عمومی به موجب مواد 10 و12 قانون دیوان، تفکیک شده است. براین اساس که به شکایات علیه تصمیمات موردی در شعب دیوان و رسیدگی به شکایات علیه تصمیمات عام‌الشمول در هیات عمومی صورت می‌گیرد؛ اما درمورد مصادیق هرکدام، چالش وجود دارد. چالش مهم‌تر درخصوص پرونده‌هایی است که ظاهرا در دیوان، نسبت به یک تصمیم موردی شکایت شده است؛ اما هیات عمومی دیوان عدالت اداری، خود را صالح به رسیدگی بدان محسوب کرده و به پرونده رسیدگی و رای صادر کرده است. در این‌گونه موارد، هیات عمومی دیوان، تصمیم موردی را دارای اثر نوعی دانسته و براین‌اساس به آن رسیدگی کرده است. در این مقاله، با تبیین مفاهیم تصمیم موردی و تصمیم عام‌الشمول، این مساله مطرح شده است که ملاک تفکیک تصمیمات موردی از تصمیمات عام‌الشمول در دیوان عدالت اداری چیست؟ نویسنده با بررسی موضوع و بویژه آرای هیات عمومی دیوان عدالت اداری، معتقد است ممکن هست برخی تصمیمات موردی، اثر نوعی داشته باشند؛ ولی تشخیص این امر، مستلزم تبیین مبانی و ملاک‌های مشخص است که در آرای هیات عمومی دیوان عدالت اداری، درمقام رسیدگی به این‌گونه پرونده‌ها ملاک مشخصی تعیین نکرده است؛ بنابراین، نویسنده خود در مقام تعیین ملاک تفکیک برآمده است.
