بررسی ابعاد حقوقی بازنشستگی قضات دادگستری در پرتو قوانین، مقررات و رویه قضایی

در میان مسائل مربوط به حقوق استخدامی قضات، موضوع بازنشستگی از اهمیت خاصی برخوردار است. با توجه به اینکه در نظام حقوقی ایران در خصوص شرایط بازنشستگی قضات، قوانین و مقررات پراکنده و ابهامات قانونی متعددی وجود دارد و بهره مندی عادلانه قضات از حق بر بازنشستگی با محدودیت ها و چالش هایی مواجه است، مقاله کنونی، با استفاده از روش توصیفی-تحلیلی و بر مبنای مطالعات کتابخانه ای به بررسی و تحلیل رویکرد نظام حقوقی ایران به بازنشستگی قضات دادگستری پرداخته است و با نگاهی به وضعیت موجود در برخی کشورهای خارجی، رویکرد آنها نسبت به بازنشستگی قضات را نیز تبیین نموده است. یافته های این مقاله، دلالت بر آن دارد، از یک سو، شرایط بازنشستگی قضات (بازنشستگی بر اساس سن و سنوات خدمت) و مبنای محاسبه حقوق بازنشستگی آنان با سایر مستخدمان دولت، تا حد زیادی تفاوت دارد و از دیگر سو، عدم کفایت مستمری بازنشستگی با توجه به میزان حق بیمه پرداختی از سوی قضات، محدودیت های انتقال سوابق بیمه ای و فقدان حق انتخاب صندوق بازنشستگی و یا تغییر صندوق بازنشستگی در دوران اشتغال، مهم‌ترین چالش های کنونی حق بر بازنشستگی قضات دادگستری در ایران هستند. به همین دلیل، به منظور برون رفت یا تعدیل این چالش ها انجام اصلاحات قانونی، ضروری به نظر می‌رسد.

the review of legal aspects of judges' retirement in the light of laws, regulations and judicial procedure

among the issues related to the employment rights of judges, the issue of retirement has particular importance. considering that there are many legal ambiguities in iran’s legal system regarding the judges’ retirement conditions and the fair enjoyment of the right to retirement by judges faces limitations and challenges, the present article, using descriptive-analytical method and based on library studies it has studied and analyzed the approach of the iranian legal system to the retirement of judges and by looking at the situation in some foreign countries, it has also explained their approach to the retirement of judges. this article findings indicate that, on the one hand, the conditions of judges’ retirement (retirement based on age and years of contribution) and the basis for calculating their pensions differ greatly from other government employees, and on the other hand, the inadequacy of the pension retirement, considering the amount of contribution paid by them, the limitations of transfer of contribution period and the lack of right to choose their pension fund or change the pension fund during employment, are the most important current challenges of the right to retirement of justice judges in iran. for this reason, in order to overcome or adjust these challenges, it seems necessary to make legal reforms.
