تحلیلی انتقادی بر شیوه‌نامه انضباطی دانشجویان

دادگاه های اختصاصی اداری یا مراجع شبه قضایی نوعی از مراجع به رسمیت شناخته در ایران هستند. برخلاف اینکه، تعداد زیادی از این دادگاه های تخصصی در ایران وجود دارد؛ هنوز نظام منسجم حقوقی برای آن ها به وجود نیامده است. کمیته های انضباطی دانشجویان، یکی از این دادگاه ها هستند که در دانشگاه ها تشکیل شده اند و به تخلفات دانشجویان رسیدگی می کنند. در سال 1398، شیوه نامه ای برای این کمیته ها به امضا و تایید وزیر علوم، تحقیقات و فناوری و وزیر بهداشت، درمان و آموزش عالی رسید که در آن کوشش شد آنها دارای نظام دادرسی منسجمی شوند. این مقاله با روش توصیفی و تحلیلی به دنبال بررسی این پرسش بوده که مهم ترین ایرادات وارده بر این شیوه نامه چه مواردی هستند. تعرض به حق تحصیل، عدم تناسب بین تنبیه و تخلف، درهم آمیزی حقوق کیفری و حقوق اداری و عدم رعایت برخی از اصول دادرسی منصفانه از مهم ترین ایرادات این شیوه نامه هستند.

Critical analysis of students' disciplinary instruction

Special administrative courts or quasi-judicial authorities are one of the recognized courts in Iran. Despite the large number of these specialized courts in Iran, a coherent legal system has not yet been established for them. Student Disciplinary Committees are one of these courts set up in universities to deal with student misconduct. In 1398, a procedure for these committees was signed and approved by the Minister of Science, Research and Technology and the Minister of Health, Treatment and Higher Education, in which an attempt was made to have a coherent judicial system. This article seeks to investigate the question of what are the most important drawbacks of this method by descriptive-analytical method. Violation of the right to education, disproportion between punishment and misconduct, integration of criminal law and administrative law, non-observance of some principles of fair trial are the most important drawbacks of this procedure.
