مبانی فقهی و حقوقی به‌کارگیری سیستم‌های الکترونیکی گزارش‌دهنده فساد در ایران

در عصر حاضر، یکی از تکنولوژی های نوین که برای مقابله با فساد اداری در برخی از کشورها مورد توجه قرار گرفته است، سیستم های الکترونیکی گزارش‌دهنده‌ فساد است. با توجه به اهمیت شفاف‌سازی و مبارزه با فساد در امور اداری در نظام جمهوری اسلامی ایران، این مقاله به روش توصیفی و تحلیلی در پی پاسخ به این سوال است که آیا می توان در نظام اسلامی نیز از چنین سیستم های نظارتی در راستای سلامت اداری و مبارزه با فساد بهره‌برد؟ مبانی و ادله فقهی و حقوقی آن کدام است؟ همچنین چالش های فقهی به‌کارگیری آن چیست؟ یافته های تحقیق نشان می دهد لزوم نظارت همگانی در امور اجتماعی، قاعده حفظ نظام اسلامی، سیره عقلا و لزوم حفظ حقوق عمومی از جمله مبانی فقهی و حقوقی به‌کارگیری سیستم های الکترونیکی گزارش‌دهنده فساد در نظام اسلامی است؛ اما به‌رغم کارایی این بستر الکترونیکی، به‌طبع خود چالش هایی از قبیل: »حفظ حرمت و آبروی کارمندان و کارگزاران، حرمت تشهیر قبل از اثبات جرم و... « را به دنبال خواهد داشت که در ادامه مقاله، راهکارهای حل چالش های موجود بررسی شده است.

Jurisprudential and legal principles of using electronic systems for reporting corruption in Iran

Today, one of the new technologies that has been considered to combat corruption in some countries is electronic systems for reporting corruption. Given the importance of transparency and the fight against corruption in administrative affairs in the system of the Islamic Republic of Iran, this article descriptively and analytically seeks to answer the question of whether in the Islamic system such monitoring systems can be benefit from administrative health and the fight against corruption?What are its jurisprudential and legal principles and arguments? Also, what are the jurisprudential challenges of using it? Findings show that the need for public oversight in social affairs, the rule of maintaining the Islamic system, the morals of the wise and the need to protect public rights are among the jurisprudential and legal principles of using electronic systems to report corruption in the Islamic system. However, despite the efficiency of this electronic platform, it will naturally lead to challenges such as maintaining the honor and dignity of employees and agents, the sanctity of defamation before proving a crime, etc. Existing checked
