واکاوی مطالعه تطبیقی حقوق بشرغربی و اسلامی با تاکید برحقوق اقلیت‌ها در ایران

رعایت حقوق اقلیت ها و منع تبعیض نسبت به آنها از جمله مسائلی مهمی تلقی می شود که اخیرا بیشتر مورد توجه و حمایت نهادهای بین‌المللی قرار گرفته است. اگر چه در سد‌ه گذشته برخوردهای خصمانه و خشونت بار با اقلیت‌ها گوناگون شده است اما در عین حال ، تمهیداتی برای رعایت حقوق اقلیت ها و تامین همزیستی مسالمت آمیز اقوام و گروه های مختلف چاره اندیشی شده است. در این راستا هدف پژوهش پیش‌رو به بررسی تفاوت‌های بین حقوق بشر اسلامی و غربی با تاکید بر حقوق اقلیت‌ها می‌پردازد. از این‌رو سوال نوشتار حاضر بر این است که در تفکر حقوق بشر اسلامی و حقوق بشر در غرب اقلیت‌ها از چه حقوق و آزادی‌هایی برخوردار هستند؟ روش به کارگرقته در این پژوهش تحلیلی –تطبیقی و روش گردآوری مطالب به صورت کتابخانه‌ای است. یافته‌های پژوهش براین است که در کشورهای غربی علیرغم تصویب قوانین حمایتی در مورد حقوق اقلیت های مختلف دولتها در برابر این اقلیت‌ها بسیار سلیقه‌ای عمل کرده و موارد متعدد نقض حقوق اقلیت‌ها و به ویزه زنان وجود دارد، اما به دقت در قانون اساسی ایران برای اقلیت‌های دینی حقوقی در نظر گرفته شده است که از جمیع این قوانین می‌توان دریافت اقلیت‌های ایران با وجود جمعیت کم از امکانات مناسبی نسبت به اقلیت‌های ساکن در کشورهای دیگر برخوردارند.

respecting the rights of minorities and prohibiting discrimination against them is considered to be one of the important issues that has recently received more attention and support from international institutions. although in the past century, hostile and violent encounters with minorities have been varied, but at the same time, measures have been taken to respect the rights of minorities and ensure the peaceful coexistence of different ethnicities and groups. in this regard, the aim of the upcoming research is to examine the differences between islamic and western human rights, emphasizing the rights of minorities. therefore, the question of the present article is, what rights and freedoms do minorities have in the islamic human rights and human rights in the west? the method used in this research is analytical-adaptive and the method of collecting materials is library. the findings of the research are that in western countries, despite the adoption of protective laws regarding the rights of different minorities, the governments have acted very tactfully against these minorities and there are many cases of violations of the rights of minorities and women’s visas, but legal rights for religious minorities have been carefully considered in the constitution of iran, and from all these laws, it can be seen that iran’s minorities, despite their small population, have adequate opportunities compared to the minorities living in other countries.
