مطالعه تطبیقی حق بهره مندی از بهداشت و سلامت درحقوق ایران، اسناد بین المللی و رویه قضاییدیوان اروپایی حقوق بشرچکیدهبهره مندی از حق بهداشت، سلامت جسمی، روانی و اجتماعی بعنوان یکی از مفاهیم بنیادین حقوق شهروندی و نسل دوم حقوق بشری می باشد. این حق موضوعی جهانی، تفکیک ناپذیر، بهم وابسته و مرتبط با یکدیگر برای همه افراد انسانی بوده و بعنوان حقوق ذاتی و طبیعی، حق احاد افراد بشر در دسترس باشد، تثبیت شده است. حال سوالی که در این پژوهش مطرح می شود، این است که منظور از حق بهره مندی از بهداشت، سلامت جسم و روان در حقوق ایران، اسلام، اسناد بین المللی و رویه قضایی دیوان اروپایی حقوق بشر چیست؟ که استدلال ما این خواهد بود، الزام به رعایت حق بهره مندی از بهداشت، سلامت جسم و روان در قانون اساسی و منشور حقوق شهروندی، حقوق اسلام و اسناد مختلف و متعدد حقوق بین الملل بشری بعنوان حقوق ضروری و نظام حقوق بشری تاکید شده است. خصوصاٌ در آراء و احکام مختلف صادره از سوی دیوان اروپایی حقوق بشر که در انتهای بحث آورده شده برای دولت های عضو این اتحادیه مورد الزام و تعهد می باشد. روش تحقیق در این پژوهش مبتنی بر مطالعه اسنادی و تحلیل محتوا است.واژگان کلیدی: حق بهداشت و سلامت، حقوق ایران، اسناد و رویه قضایی، دادگاه اروپایی حقوق بشر.

comparative approach to the right of enjoying hygiene and health at iran’s rights, international documents judicial process of european court of human rights

enjoying hygiene right, physical, social and mental health is considered as one of fundamental concepts of citizens’ rights and second generation of human rights. this right is global, inseparable, interdependent and related case with each other for all human and it is accessible as intrinsic and natural right of all humankind. now, the question which is posed at this study is that: what does it mean by the right of enjoying hygiene, mental and physical health at iran, islam’s rights, international documents and judicial process of european court of human rights? our reasoning will be such that being forced to follow the right of enjoying sanitation, physical and mental health at constitution and charter on citizens’ rights, islam’s rights, different and several documents of international human rights was emphasized as necessary rights and human rights system. specially, by considering different judicial decisions and judgments rendered by european court of human rights which have been discussed at the end of article, these rights are committal for governmental members of this union. the study method of this research is based on documentary study and content analysis.
