پیشگیری از جرم جاسوسی سایبری نیروهای مسلح و نقش آن در تامین حقوق بشر

ﺑﺮای ﺑﺮﻗﺮاری اﻣﻨﯿﺖ و ﺣﻔﻆ ﻣﺮزﻫﺎی ﮐﺸﻮر ﺑﺎﯾﺪ از درز اﻃﻠﺎﻋﺎت ﺟﻠﻮﮔﯿﺮی ﮐﺮد ﮐﻪ اﯾﻦ وﻇﯿﻔﮥ ﻣﻬﻢ ﺑﺮ ﻋﻬﺪة ﺗﻤﺎم ﻣﺮدم ﺳﺮزﻣﯿﻦ ﺑﻪوﯾﮋه ﻧﯿﺮوﻫﺎی ﻣﺴﻠﺢ اﺳﺖ. ﺟﺎﺳﻮﺳﯽ از ﺟﻤﻠﻪ ﺟﺮاﯾﻤﯽ اﺳﺖ ﮐﻪ ﺗﻬﺪﯾﺪ ﺟﺪی ﻋﻠﯿﻪ اﻣﻨﯿﺖ ﮐﺸﻮر ﺑﻮده و از ﻣﻬﻢﺗﺮﯾﻦ ﻣﺼﺎدﯾﻖ ﺣﻘﻮق ﺑﺸﺮی ﻣﺤﺴﻮب ﻣﯽﺷﻮد. ﺑﺮ اﯾﻦ اﺳﺎس ﭘﯿﺸﮕﯿﺮی از ﺟﺎﺳﻮﺳﯽ ﺳﺎﯾﺒﺮی ﺑﺮای ﺗﺄﻣﯿﻦ اﻣﻨﯿﺖ اﻫﻤﯿﺖ دارد. در ﭘﮋوﻫﺶ ﺣﺎﺿﺮ ﺑﺎ روش ﺗﻮﺻﯿﻔﯽ ﺗﺤﻠﯿﻠﯽ، راهﻫﺎی ﭘﯿﺸﮕﯿﺮی از ﺟﺮم ﺟﺎﺳﻮﺳﯽ ﺳﺎﯾﺒﺮی ﻧﯿﺮوﻫﺎی ﻣﺴﻠﺢ ﻣﻮرد ﺑﺮرﺳﯽ ﻗﺮار ﮔﺮﻓﺘﻪ اﺳﺖ. ﻧﺘﺎﯾﺞ ﺗﺤﻘﯿﻖ ﻧﺸﺎن ﻣﯽدﻫﺪ اﺳﺘﻔﺎده از ﻫﺮ دو روش ﭘﯿﺸﮕﯿﺮی ﮐﯿﻔﺮی و ﻏﯿﺮﮐﯿﻔﺮی ﻣﯽﺗﻮاﻧﺪ در ﭘﯿﺸﮕﯿﺮی از ﺟﺎﺳﻮﺳﯽ ﺳﺎﯾﺒﺮی ﻣﺆﺛﺮ ﺑﺎﺷﺪ. ﺗﺸﺪﯾﺪ ﻣﺠﺎزات ﻧﻈﺎﻣﯽ ﮐﻪ درﺟﮥ ﺑﺎﻟﺎﺗﺮی دارد، ﻣﯽﺗﻮاﻧﺪ ﯾﮑﯽ از راﻫﮑﺎرﻫﺎی ﭘﯿﺸﮕﯿﺮی ﮐﯿﻔﺮی ﺑﺎﺷﺪ. درﺑﺎره ﭘﯿﺸﮕﯿﺮی ﻏﯿﺮﮐﯿﻔﺮی ﻧﯿﺰ ﺗﮑﻨﯿﮏﻫﺎی ﭘﯿﺸﮕﯿﺮی وﺿﻌﯽ و اﺟﺘﻤﺎﻋﯽ ﻗﺎﺑﻞاﺟﺮاﺳﺖ و ﻧﯿﺰ ﻣﯽﺗﻮان از روشﻫﺎی ﺧﺎص ﭘﯿﺸﮕﯿﺮی، وﯾﮋه ﺟﺮاﯾﻢ راﯾﺎﻧﻪای ﻧﯿﺮوﻫﺎی ﻣﺴﻠﺢ ﻫﻤﭽﻮن دﻗﺖ در اﻧﺘﺨﺎب ﻓﺮﻣﺎﻧﺪه، رﻓﻊ ﻓﻘﺮ و ﺗﺒﻌﯿﺾ ﻧﺎروا در ﭘﯿﺸﮕﯿﺮی از ﺟﺎﺳﻮﺳﯽ ﺳﺎﯾﺒﺮی ﺑﻬﺮه ﮔﺮﻓﺖ.

The role of armed forces cyber espionage prevention on the right to security

The characteristic of any crime is that it endangers security. In this case, the penal system intervenes to express a reaction against the crime to restore the lost security. Considering that in espionage crime, security is more endangered than other crimes and considering that today most crimes are committed in cyber form and on the other hand because the armed forces have an important role in providing security and committing cyber espionage crime by They are considered as a more serious threat to security. In the present study, descriptiveanalytical methods were examined to prevent cyber espionage of the armed forces in order to prevent security from being compromised. The results of the present study indicate that the use of both criminal and noncriminal prevention methods can be effective in preventing cyber espionage. For example, intensifying military punishment, which has a higher degree, can be considered as one of the criminal prevention strategies. Regarding noncriminal prevention, situational and social prevention techniques can be used, which are considered as applicable methods in all crimes, and it is also possible to resort to a series of special prevention methods, especially for computer crimes. The armed forces, such as careful selection of commanders, poverty alleviation, and undue discrimination, prevented them from committing crimes in order to ensure security.
