گفتمان حقوق بشر در اسلام: تبیینی از منظر کرامت انسانی

هدف این مقاله آن است تا ضمن تبیین مفهوم کرامت انسانی و مصادیق حقوق بشر از دیدگاه اسلام، به توضیح نسبت آن در نظام حقوقی اسلام با کرامت ذاتی و اکتسابی انسانی بپردازد. مفهوم حقوق بشر مفهومی مدرن است و همچون دیگر مفاهیم مدرن وارد ادبیات اسلامی شده است. مباحث مطرح شده پیرامون این حوزه، گفتمان مفهومی خاصی را شکل داده است که از آن به گفتمان حقوق بشر اسلامی تعبیر می شود. در این گفتمان، کرامت انسانی دال برتر و مرکزی و در کانون توجه است و کلیه حقوق و امتیازات بشری به عنوان دالهای شناور بر گرد همین مفهوم درک و دریافت می شوند. این مقاله با طرح این پرسش که گفتمان حقوق بشر در اندیشه اسلامی چگونه قابل تبیین است، با اتکا بر روش توصیفی  تبیینی بر این نظر است که در اندیشه اسلامی گفتمان حقوق بشر بر مبنای اصل کرامت انسانی قابل تبیین بوده و بر این اساس رعایت حقوق بشر امری واجب و تعدی به آن موجب نقض کرامت انسانی و در نتیجه حرام است.

Human Rights Discourse in Islam: An Explanation from Human Dignity Perspective

The main goal of the article is explanation and description of relationship betweenhuman dignity and human rights discourse in Islam. Human rights conception is amodern concept and like some other modern conception has entered to Islamicliterature recently. In Islamic text we have not seen human rights conception butsigns and symbol of the concept is exist in Quran (Islam holy book) and Islamictradition and hence, Islam Olamas and religious scholars have discussed about that.We can named the discussion as Islamic human rights discourse. In the discourse,human dignity is central sign and other rights and human advantages are understoodaround the concept. This article is seek to answer the question that whatcharacteristics we can see in Islam human rights discourse? The article as ahypothesis and based on descriptiveexplanative method argues human rights inIslam is based on human dignity and the obliged to it is necessary.
