The Power of the Purse as the Main Powerful Weapon of the Legislature: A Theoretical Approach

There is the need for today’s modern and pluralistic democracies around the world to give an answer to a paradoxical question: “is public budget about a right or a power of the legislature?” the answer that is going to be sought for should be indicating to a notion where legislature budgeting sovereignty should exist. hence, english originated understanding of supremacy of parliamentary puts the legislations’ will on public funds via the power of the purse. legislature holds the occasion of investigating decisions on fiscal policies what belongs to execution, foresights which contradict with the preferences of fellow citizens, preventing any illegal fiscal retrenchments beforehand by exercising the power of the purse as the fiscal assurance of constitutional order. notwithstanding, as the power of the purse got weaken via the implementation of several practices, legislature gets ineffective and executive employs a more visible dominance. at the same time, where the limits and basic principles of the practice of the power of the purse is being remained the usage of the power of the purse is limited by the legal procedures. therefore, initially theoretical perspective of power of the purse should be put forward. this study aims to describe the fact that power of the purse is a power of legislation and as a consequence the same condition for citizens. in this respect, firstly, theoretical framework of the power of the purse has been settled and following that main pillars of practices of the power of the purse under government systems has been explained and lastly there are some offerings to take some measures on the issue of protecting this power. following this theoretical approach, there is the finding that presidential system is a one where legislation actively participates to budgetary process concerning the practicing the power of the purse.
