“Using Drugs and Stımulants” in Urban Places as an Example of Victimless Crime in Turkey

Although the term “victimless crime” is available in the doctrine, it is a concept which has just been studied and examined in concrete cases in turkey. the term can be interpreted most simply as any crime with no victim. the study aimed at investigating the concept “victimless crime” in the cases of using drugs and stimulants. in the first place, literature review on the subject was made in the study. later, the study was supported with secondary data using the official statistics of the ministry of justice, central monitoring station of drug and drug dependence in turkey and the general directorate of security. it was established in the study that the clearest statements about victimless crimes in turkish penal legislation were available in turkish penal code bill number 5237. according to this, accepting, carrying and buying drugs and stimulants to use were all recognized as victimless crimes. from this aspect, the perception “there is no victimless crime”, which is the reflection of the typical theory of crime in turkey, was undermined. in addition, a meaningful relation was found between the dark numbers and victimless crimes. the study ended giving recommendations on victimless crimes to government executives with positions of legislator and legislation officer.
