TRUST RESPONSIBILITY AND “CULPA IN CONTRAHENDO”

Trust responsibility stems from the breach of the obligations of behaviour which base on the rule of honesty. a responsibility which formed as a result of the creation of law of the judge is in question in the events which are characterized as neither contract nor tort liability, in case of the frustrating this trust in way contrary to the rule of honesty of persons who provide trust here. this responsibility is a top concept which also includes responsibility arising from culpa in contrahendo. therefore trust responsibility is neither the responsibility of the contract nor tort liability like in responsibility arising from culpa in contrahendo. the category of a third responsibility which locates between both is on the carpet here. trust responsibility also covers responsibility which arise from violation of protection obligations after contract, in the continuation of the contract, along with responsibility arise from culpa in contrahendo.
