HISTORICAL DEVELOPMENT OF UNDERSTANDING OF COMPENSATION FOR VICTIMS OF CRIME

Human societies need to be protected and order and justice; state is an instituion which has been formed for these necessities. human being is a social creature and has tried to take precautions against risks that may be faced in order to live safely throughout the history. after behavior that causes injustice exists, it is not possible to make this injustice unrealized. it is necessary to impose sanctions for maintanence of law order and restoration of disrupted balance. one of the other aims of imposing sanctions is resolving grievance of the victim. the indemnity of the damage caused by crime is an issue that has been emphasized since early ages. indemnity is payment of damages which are caused by an act and process against law. recovering of the financial loss reasonably is essential. the laboratory of jurisprudence is the history of law. in this study, historical development of understanding of compensation to victims and especially the situation in islamic law will be handled.
