   THE APPLICATION OF “NO-FLY ZONE” AND ITS LEGAL THEORY IN THE EXAMPLE OF LIBYA OPERATION

چکیده    One of the most significant public acts named arabian spring which has an immediate effects in middle east has arisen in libya. the bloody period in libya has caused a legal ground for international public interference and led to a consultation for “no-fly zone”. after it has been perceived as a threat for peace and recognized that the cautions without force has not been sufficient for international peace, the interference and the application of no-fly zone in question has led upon the resolution no. 1973 which was taken by the security council. although the application of no-fly zone can be perceived as a passive action, it is a highly probable case that can be turn into a military action. accordingly it is possible to state that the resource for this application must be the 42th. article of the charter of united nations.
