تحلیلی بر کاربرد «مواهب اجتماعی» در قانون اساسی جمهوری اسلامی ایران

مواهب اجتماعی از عناوین مهم عدالت توزیعی است که در حوزه مباحث عدالت اجتماعی مطرح می‌شود. مصادیق، ملاک‌های توزیع، و گروه‌های دارای استحقاق به عنوان مسائل سه‌گانه عدالت توزیعی همواره مورد بحث و بررسی اجتماعی و حقوقی است. پاسخ به مسائل یادشده در نحوه بهره‌مندی افراد از ثروت‌ها، موقعیت‌ها، و ارائه شاخص‌های عدالت تعیین‌کننده خواهد بود. با توجه به اهمیت مباحث مواهب عامه در حقوق عمومی، مسئله اصلی پژوهش حاضر شناسایی و تبیین و پاسخ به مسائل سه‌گانه یادشده از منظر قانون اساسی است. در این مقاله با استفاده از روش تحلیل محتوا عناوین مواهب اجتماعی و مسائل مرتبط با آن مورد تحلیل و پژوهش قرار گرفت. نتایج بیانگر آن است که بر مبنای قانون اساسی عناوین متعددی ذیل عنوان مواهب اجتماعی قرار می‌گیرند. این مواهب باید بر اساس ملاک‌هایی چون برابری فرصت، برابری برخورداری، و برابری قانونی در جوامع هدف توزیع شوند. توجه به این مواهب و مرور مجدد مصادیق آن بستر مناسبی برای شناخت بهتر قانون اساسی و بنا نهادن صحیح‏‌تر سایر سیاست‌ها و اسناد در حوزه‏‌های مرتبط ایجاد خواهد کرد.

an analysis on the use of social benefits in the constitution of the islamic republic of iran

social benefits are one of the important topics of distributive justice discussed in the field of social justice. for instance، criteria of distribution and entitled groups as three issues of distributive justice are always discussed and investigated socially and legally. the importance of the answers to the mentioned issues will be decisive in the way people benefit from wealth، positions and the presentation of justice indicators. considering the importance of public goods issues in public law، the main problem of the current research is to identify، explain and answer the mentioned issues from the perspective of the constitution. in this paper، using content analysis method، the titles of social gifts and related issues were analyzed and researched. the results show that according to the constitution، many titles are included under the title of social benefits. these benefits should be distributed in target communities based on criteria such as equality of opportunity، equality of opportunity، legal equality and general equality. considering these gifts and revisiting its examples will create a suitable platform for a better understanding of the constitution and a more correct establishment of other policies and instruments in related fields.
