شاخص‌‏های انطباق مصوبات مجلس با سیاست‏‌های کلی با نگاهی به نظرات هیئت عالی نظارت بر حُسن اجرای سیاست‌های کلی نظام

هیئت عالی نظارت بر حسن اجرای سیاست‌‏های کلی نظام، بر اساس ماده 6 آیین‌نامه نظارت بر حسن اجرای سیاست‏های کلی نظام، کارویژه ارزیابی مصوبات مجلس در چارچوب مغایرت و عدم انطباق آن‌ها با سیاست‌های کلی نظام را در دستور کار خود دارد. با توجه به فقدان شاخص‏های مشخص برای ارزیابی مصوبات مجلس از حیث انطباق با سیاست‌های کلی و همچنین نقش این شاخص‏ها در کارآمدسازی نظارت بر اجرای سیاست‌های کلی، پژوهش در زمینه ارائه این شاخص‏ها مسئله‏‌ای مهم است. به همین دلیل، در این مقاله، با استفاده از روشی توصیفی‌- تحلیلی و با اتخاذ رویکردی حقوقی، به این سوال پاسخ داده شده است که چه شاخص‌هایی در احراز انطباق مصوبات مجلس با سیاست‏های کلی وجود دارد؟ در این زمینه نیز از دکترین حقوقی، تحلیل علمی، و همچنین نظرات هیئت عالی نظارت برای دست‏یابی به این شاخص‏ها استفاده شده است. در این مقاله، پس از تدقیق در مبانی مورد نظر پژوهش و مفهوم‌شناسی انطباق، شاخص‏های یادشده در دو دسته شاخص‏های اصلی و شاخص‏های فرعی تفکیک شده است و مواردی چون «احراز جامعیت و شمول»، «تفصیل کافی احکام»، «تناسب با اولویت‏ها» در بخش شاخص‏های اصلی و مصادیقی چون «احراز ثبات و استمرار نسبی هنجارها»، «استناد هنجارها به احکام سیاستی»، «عدم تعارض در آثار هنجارها»، «کارایی و اثربخشی سازکارهای اجرا»، «ضمانت اجرای لازم و متناسب» در بخش شاخص‏های فرعی مطرح شده است.

according to article (7) of the regulations for monitoring the good implementation of the general policies, the supreme board of supervision of the good implementation of the general policies follows the mission of evaluating the approvals of the parliament in terms of their non-contradiction and compliance with the general policies. considering the lack of specific indicators for the evaluations of the parliament in terms of non-compliance with the general policies, research in the field of providing these indicators is an important issue. this paper, using a descriptive-analytical method and inquiring legal questions, what indicators are there in verifying the compliance of the parliament with the general policies? in this context, legal doctrine, scientific analysis, as well as the opinions of the supreme supervisory board are used to achieve these indicators. these indicators are divided into two categories: main indicators and sub-indexes, and things like verifying comprehensiveness and inclusiveness, adequate details of rulings and proportion with priorities are in the main index sections and examples. because ensuring relative stability and continuity, reference of norms to political rulings, no conflict in the effects of norms and efficiency and effectiveness of implementation mechanisms have been mentioned in the sub-index section.
