ایدئولوژی جهان‌وطنی و نقش آن در تاریخ تحولات حقوق بین‌الملل با تاکید خاص بر اصل 154 قانون اساسی جمهوری اسلامی ایران

جهان‌وطنی ایده‌ای است که بر مبنای آن انسان‌ها بدون توجه به وابستگی‌های نژادی، ملی، مذهبی، فرهنگی و ...، همگی از شهروندان یک اجتماع واحد محسوب می‌شوند. از طرف دیگر، مفهوم امت‌واحده اسلامی نیز ناظر بر وحدت آحاد بشر، اما بر مبنای اتحاد ایدئولوژیک و اسلامی میان آن‌هاست. از این دیدگاه، شاید بتوان اندیشه امت‌واحده اسلامی را به‌نوعی «جهان‌وطنی اسلامی» تعبیر  کرد. حال سوال این است که اولاً قانون اساسی و رویه عملی جمهوری اسلامی ایران متاثر از کدام‌یک از اندیشه‌های مذکور بوده و ثانیاً نگاه آرمانی نظام اسلامی حاکم بر کشور به مقوله اتحاد میان مسلمانان و استقرار یک حکومت واحد جهانی، تا چه حد با موازین حقوق بین‌الملل منطبق است؟ یافته‌های تحقیق که مبتنی بر روش تحقیق توصیفی– تحلیلی و بر مبنای مطالعات کتابخانه‌ای و اسنادی است، حکایت از این دارد که جمهوری اسلامی از لحاظ نظری و رویه عملی، ضمن تلاش در جهت تحقق جامعه مبتنی بر اندیشه امت‌واحده و استقرار حکومت جهانی اسلام، خود را همواره متعهد به اصول پذیرفته‌شده در حقوق بین‌الملل، از  جمله اصل عدم مداخله می‌داند. اهمیت تحقیق در تنویر افکار نسبت به انطباق رویکرد کشورمان در جهان‌وطنی بر مبنای امت‌واحده با موازین حقوق بین‌الملل است.

cosmopolitanism & its role in international law transitions history, focusing on article 154 of the constitution of the islamic republic of iran

cosmopolitanism is an idea according to which human beings, regardless of racial, national, religious, cultural, etc. are all citizens of a single community. on the other hand, the concept of the islamic united ummah also refers to the unity of human beings but is based on ideological and islamic unity between them. from this point of view, perhaps the idea can be interpreted as a kind of islamic cosmopolitanism. the main questions of this research are “which of the mentioned ideas has influenced the constitution and the practical procedure of the islamic republic of iran?” and “to what extent does the ideal view of the ruling islamic system on the issue of unity among muslims and the establishment of a single world government, comply with international law standards?” the research findings, which are based on descriptiveanalytical research methods and based on library and documentary studies, indicate that theoretically and practically, the islamic republic of iran, while striving for the realization of a society based on the idea of a single nation and the establishment of a world islamic government, has always considered itself committed to the principles accepted in international law, including the principle of noninterference. the importance of this research is enlightening the thoughts towards the adaptation of our country’s approach to cosmopolitanism based on the united ummah with international law.
