جستاری بر نظریه مدیریت دولتی نوین و جایگاه آن در حقوق اداری

مدیریت دولتی نوین اندیشه‌ای است که به اجرای قانون از طریق فرایندهای سازمانی و مدیریتی تمرکز دارد. در گفتمان‌های نوین در مدیریت دولتی، هدف اصلی شکل‌گیری و تقویت کارامدترین نظام اداری است. تمامی تحولاتی که در ساختار و نیز عملکرد دولت‌ها رخ می‌دهد، در نهایت باید به ارتقای کارامدی و اثربخشی دولت‌ها منجر شود. نهضت بازآفرینی اداره به اتکای آموزه‌های اندیشه مدیریت دولتی نوین، در نقش و کارکرد‌های اداره دگرگونی‌هایی در پی داشت. امروزه دولتی کارامد محسوب می‌شود که بتواند از قدرت، مهارت و تخصص شهروندان خود در هر رده و صنف و فعالیتی که هستند، بهره ببرد. مداخله فعال و هدفمند شهروندان در تصمیم‌گیری‌های عمومی مدیریتی، نه‌تنها سیاست‌ها و تصمیم‌ها را با توقعات عمومی هماهنگ‌تر می‌سازد، بلکه اقبال عمومی از آن‌ها، تضمین وثیقی برای اجرا و عملیاتی شدن تصمیمات اداره است. نگاه ویژه به دانش مدیریت دولتی موجب شده است که آموزه‌های حقوق عمومی نیز با هدف کارامدی اداره متحول شود. این پژوهش با نگاهی تحلیلی به بازتاب اندیشه‌های مدیریت دولتی نوین در حقوق اداری پرداخته و به این نتیجه رسیده است که برای تحقق مدیریت دولتی نوین در نظام اداری ایران، مولفه‌های مهمی چون اصل پاسخگویی، شفافیت، فسادستیزی، مشارکت‌محوری، شایسته‌سالاری، قانون‌مداری و تمرکززدایی باید تقویت شود.

the theory of modern government management & its position in modern administrative law

new government management is the title of a theory that focuses on law enforcement through organizational and management processes, especially in the last three decades. it seeks to rediscover the functions of government and change the structures and procedures of exercising public authority, as a model for planning an effective government. the initial basis for the discussion of this theory is the knowledge of public administration, but due to the close relationship between public administration and administrative law, it has gradually become a rooted issue in this branch of law. this theory seeks to form a modern government by moving away from the traditional model of management (public administration) and reducing the disadvantages of wornout and dysfunctional management systems, by creating fundamental changes in the structure and procedures of implementation. naturally, modern administrative law can not be indifferent to this new approach. with an analytical view, this research reflects the ideas of modern public administration in administrative law and has come to the conclusion that for the realization of new government management in iran’s administrative system, important components such as the principle of accountability, transparency, anticorruption, participationoriented, meritocracy, rule of law and decentralization, should be strengthened.
