بایسته‌های حقوقی تفویض اختیار صلاحیت‌های رئیس‌جمهور به معاونان در نظام حقوق اساسی ایران با نگاهی به نظرهای شورای نگهبان

رئیس‌جمهور مطابق اصل 124 قانون اساسی می‌تواند انجام برخی وظایف قانونی خود را تفویض کند. معاونت‌های ریاست‌ جمهوری به اعتبار ماهیت وظایف و اختیاراتشان به دو دسته تقسیم می‌شوند؛ معاونت‌هایی که فقط عهده‌دار امور معاونت هستند که ماهیت اختیار آن‌ها، تفویضی است و معاونت‌هایی که ریاست دستگاه یا سازمان‌های تحت نظارت رئیس‌جمهور را نیز بر عهده دارند که ماهیت وظایف آن‌ها ذاتی است. سوال این پژوهش آن است که معاونان، کدام‌یک از وظایف رئیس‌جمهور را می‌توانند عهده‌دار شوند و بایسته‌های حقوقی حاکم بر این مسئله چیست؛ امری که نوشتار حاضر با رویکرد توصیفی تحلیلی و با توجه به نظرهای شورای نگهبان درصدد پاسخ به آن است. یافته‌ها بیانگر آن است که رئیس‌جمهور می‌تواند وظایف خویش به‌غیر از وظایف اصلی و قائم به شخص را با رعایت شرایط تفویض اختیار واگذار کند؛ رئیس‌جمهور از صلاحیت انحصاری تعیین وظایف و اختیارات معاونت‌های ریاست ‌جمهوری برخوردار است؛ مسئولیت سیاسی شامل معاونان رئیس‌جمهور نمی‌شود، اما مجلس می‌تواند از را‌ه‌های دیگر بر معاونان رئیس‌جمهور نظارت کند و در عین حال معاونان رئیس‌جمهور مسئولیت اداری و قضایی دارند.

Legal Requirements for Delegating The Powers of The President to Deputies in the Constitutional System of Iran Focusing on The Guardian Council’s Decisions

According to Article 124 of the Constitution, the president can delegate some of his legal duties. Deputies of the president are divided into two categories according to the nature of their duties and powers: Deputies who are solely responsible for the affairs of the deputies, whose authority is delegated by nature, and deputies who are also in charge of the apparatus or organizations under the supervision of the President, whose nature of duties is inherent. The main question of this research is: ”Which duties of the vicepresidents can be performed by the deputies and what are the legal requirements governing this issue?” This is the main challenge that the present article seeks to resolve with a descriptiveanalytical approach and by focusing on the opinions of the Guardian Council. The findings indicate that the President can delegate his duties in addition to the main and vertical duties of a person by observing the conditions of delegation. The president has the exclusive authority to determine the duties and powers of the vicepresidents. Political responsibility does not include vice presidents, but parliament can oversee vicepresidents in other ways, while vicepresidents have administrative and judicial responsibilities.
