مجلس شورای اسلامی و لزوم ارزیابی تاثیرات قانون در مرحله تقنین

امروزه ارزیابی تاثیرات قانون فرایند بسیار مهمی است که در روند قانونگذاری باید به آن توجه شود. به‌منظور تحقق این فرایند، نهادهای مختلفی باید ایفای نقش کنند. از مهم‌ترین نهادهایی که در کشورهای مختلف در این زمینه باید وظایفی را انجام دهند، مجالس قانونگذاری کشورها هستند. حال سوال این است که در جمهوری اسلامی ایران مجلس شورای اسلامی با توجه به وظایف و اختیارات خود چه جایگاهی در تحقق فرایند ارزیابی تاثیرات قانون دارد؟ برای پاسخگویی به این پرسش با استفاده از روش توصیفی تحلیلی بیان خواهد شد که مجلس شورای اسلامی با توجه به وظیفه قانونگذاری و نظارت که بر عهده دارد و نیز ظرفیت ساختاری بخش‌های مختلف مجلس، می‌تواند مهم‌ترین نقش را در فرایند ارزیابی تاثیرات قانون بر عهده داشته باشد. در این زمینه مجلس شورای اسلامی می‌تواند از نظرهای گروه‌های مدنی و کمک سایر نهادها نیز برای ارزیابی تاثیر قانون بهره ببرد.

Islamic Consultative Assembly & the Necessity of Regulatory Impact Assessment in the Legislative Stage

Today, Regulatory Impact Assessment is a very important process that must be considered in the legislative process. In order to take place, various institutions must play a role. One of the most important institutions is the legislative body of each country. This is observed in many countries that have to perform their duties in this field. Now focusing on the Islamic Republic of Iran’s legal system, the main question is: “what is the position of the Islamic Consultative Assembly in terms of its duties and powers in the implementation of the process of Regulatory Impact Assessment?” To answer this question, using a descriptiveanalytical method, it will be stated that the Islamic Consultative Assembly, considering its legislative and oversight duties, as well as the structural capacity of different parts of the Assembly, can play the most important role in the process of Regulatory Impact Assessment. In this regard, the Islamic Consultative Assembly can use the views of civic groups and the help of other institutions to Regulatory Impact Assessment.
