امکان‌سنجی حقوقی تصویب لایحه‌ بودجه در کمیسیون‌های داخلی مجلس شورای اسلامی

اصل 52 قانون اساسی، رسیدگی و تصویب بودجه سالانه کشور را در صلاحیت مجلس شورای اسلامی قرار داده است. از سوی دیگر، اصل 85 قانون اساسی قانون‌گذاری را در صلاحیت مجلس شورای اسلامی می‌داند و تفویض تصویب قوانین به کمیسیون‌های داخلی مجلس را صرفاً در شرایطی امکان‌پذیر دانسته است. پژوهش پیش‌رو با بهره‌گیری از مطالعات کتابخانه‌ای و اتخاذ رویکردی تحلیلی توصیفی، در مقام تبیین نسبت میان اصول 52 و 85 قانون اساسی و امکان‌سنجی تصویب لایحه‌ بودجه در کمیسیون‌های داخلی مجلس به این نتیجه رسید که رویکرد عدم جواز تصویب آزمایشی بودجه به لحاظ حقوقی از قوت بیشتری برخوردار است. دیدگاه جواز تصویب آزمایشی بودجه، بر پایه‌ چهار محور «استناد به فلسفه‌ قانون‌گذاری آزمایشی»، «استناد به عدم تحقق ضرورت مندرج در اصل 85 نسبت به قوانین بودجه»، «استناد به استثنایی بودن تفویض قانون‌گذاری و اکتفا به قدر متیقن در تفسیر آن» و «تخصیص بودجه از مفاد اصل 85 قانون اساسی» استوار است و در مقابل، دیدگاه عدم جواز تصویب آزمایشی بودجه، استدلال خود را بر پایه «عدم تغایر فلسفه‌ قانون‌گذاری آزمایشی با تصویب آزمایشی قانون بودجه»، «تشابه بودجه و سایر قوانین به لحاظ اجرای آزمایشی»، «شمول ضوابط عام و استثنایی قانون‌گذاری مجلس نسبت به قانون بودجه» و «ارائه‌ تحلیلی نو عبارت از «بعضی از قوانین»» بنا نهاده است.

Legal Feasibility of Approving the Budget Bill in the Internal Commissions of the Islamic Consultative Assembly

The Article 52 of the Constitution makes the review and approval of the annual budget of the country within the competence of the Islamic Consultative Assembly. On the other hand, Article 85 of the Constitution considers legislation to be within the competence of the Islamic Consultative Assembly and considers the delegation of the approval of laws to the internal commissions of the Assembly to be possible only under certain conditions. This research by using library studies and adopting an analyticaldescriptive approach, in the position of explaining the relationship between the Articles 52 and 85 of the Constitution and the feasibility of approving the budget bill in the internal commissions of the parliament has reached the conclusion that the unauthorized approach to experimental budget approval is legally more robust. The licensebased approach for experimental approval of the budget, is based on four axes: Philosophy of the experimental legislation, Nonfulfillment of the necessity stated in Article 85 of the budget laws, Exceptional nature of legislative delegation and suffice to axioms in its interpretation and budget allocation based on the provisions of Article 85 of the Constitution. On the contrary, the view of the impermissibility of experimental budget approval is based on Compatibility in the philosophy of experimental legislation with experimental budget law, Similarity of budget and other laws in terms of experimental implementation, Inclusion of general and exceptional rules of legislation in relation to the budget law and Presentation of a new analysis of the phrase Some Laws .
