مسئولیت مدنی ناشی از نقض اعتماد به اعلام‌ها و تصمیمات دولت

رشد همزمان دولت رفاه و جامعه اطلاعاتی، موجب دگرگونی ماهیت رابطه بین دولت و شهروندان شده است. تصمیم و اعلام‌های اداری در زندگی اشخاص، موثر بوده و مردم با اعتماد و اتکای به آن‌ها برنامه‌ریزی، اقدام و هزینه‌ می‌کنند یا فرصت‌هایی را از دست می‌دهند. با عدول دولت از تصمیم یا اعلام‌های خود، تمام یا بخشی از برنامه‌ریزی، اقدام و هزینه اشخاص یا فرصت‌های ازدست‌رفته بیهوده و بی‌حاصل می‌شود. در چنین مواردی با اثبات تقصیر می‌توان حکم به جبران خسارت علیه دولت صادر کرد. مسئولیت دولت در مقابل شهروندان از نوع قهری و با احراز رابطه سببیت، دولت ملزم به جبران زیان است. در زیان‌های مستقیم، توجیه مسئولیت دولت دشوار نیست، اما در خصوص از دست دادن موقعیت‌ها و اقداماتی که با اتکا به تصمیم یا اعلام دولت انجام می‌گیرد و با عدول دولت از آن‌ها ممکن است به زیان شهروندان منجر شود، توجیه مسئولیت دولت دشوار، ولی ممکن به‌نظر می‌رسد. هدف مسئولیت مدنی ناشی از نقض اعتماد در راستای حمایت از انتظارات مشروع آن است که طرف زیان‌دیده حداقل در موقعیتی قرار گیرد که اگر چنین تصمیمی اتخاذ یا اعلامی از سوی دولت نبود، در آن موقعیت قرار داشت.

The administrative decisions and announcements are effective in people’s lives, and people are planning and operating with trust and reliance on them or losing opportunities. With the government deviating from its decisions and announcements, all or part of planning, action and expense of people or missed opportunities will be wasted. In such cases, in case of proving fault, the government may be ordered to compensate. The government has coercive responsibility against citizens and by establishing a causal relationship, the government is obliged to compensate the damages. In direct damages, the government’s responsibility is not difficult to justify but it is impossible to justify the government’s responsibility, especially from the loss of opportunities and measures that have been made due to the government’s decisions or announcements that might harm citizens. The purpose of the civil liability for breach of reliance in order to protect the legitimate expectations is to put the harmed party in a situation that if such a decision was not taken, the party would still remain in the same situation.
