گستره و اقتضائات نظارت استصوابی بر انتخابات در نظرات شورای نگهبان؛ با تاکید بر انتخابات مجلس شورای اسلامی

اهمیت نظارت بر انتخابات، ریشه در جایگاه ممتاز انتخابات در پهنه حقوق و سیاست دارد. انتخابات به‌مثابه فرایند مسالمت‌آمیز و قانونی انتقال قدرت، سازوکاری است برای اعمال حق تعیین سرنوشت به‌منظور نیل به نظامی کارامد و شایسته‌سالار. نظارت شورای نگهبان بر فرایندها و مراحل و امور انتخابات به‌ویژه انتخابات مجلس همواره در کانون مباحث حقوق انتخابات ایران بوده است. تاثیر این نظارت بر نتیجه‌ انتخابات بی‌نیاز از توضیح است و در مطالعات و نوشتارهای گوناگون بدان پرداخته شده است. بُعد مغفول در ادبیات کنونی، رویکرد پاسدار تقنینی قانون اساسی به گستره و اقتضائات نظارت بر انتخابات است. تحلیل اینکه شورای نگهبان در رویه‌ تطبیقی خود در مقام بررسی مصوبات مجلس (موضوع اصل 94)، چه قلمرو و الزاماتی را برای تحقق نظارت بر انتخابات (مقرر در اصل 99) ترسیم کرده، موضوعی ابتکاری است که این مقاله با روش تحلیل رویه‌ای در پی بررسی آن بوده است. یافته‌های پژوهش نشان می‌دهد رویه تطبیقی شورای نگهبان با مدلول نظر تفسیری اصل 99 و نیز با مفهوم، مدلول و غایت نظارت در حقوق عمومی همراستاست. اظهارنظرهای شورای نگهبان مستند به اصل 99، «موثر بودن»، «اختصاصی بودن»، «عمومیت و فراگیری» و «انحصاری بودن» نظارت بر انتخابات را نمایش می‌دهد.

The Scope and Requirements of the Election Supervision in the Guardians Council’s Decisions; with the Emphasis on the Parliamentary Elections

The importance of monitoring election is rooted in the distinguished position of the election in the context of law and politics. Election as a peaceful and legitimate process of transferring power is a mechanism for exercising selfdetermination right in order to achieve an effective and meritocratic system. Monitoring of the Guardian Council on the processes and stages of the election, in particular the parliamentary elections, has always been at the heart of Iran’s election law discussions. The effect of this monitoring on the outcome of the election is beyond explanation and has been addressed in various studies and writings. The neglected dimension in the current literature is the approach of the Constitutional review entity regarding the scope and requirements of monitoring the election. This subject is explored through a procedural analysis approach. The findings of the research show that the approach of the Guardian Council conforms to the interpretative opinion of the Article 99 as well as with the concept and purpose of monitoring in public law. The opinions of the Guardian Council show Effectiveness, specialization comprehensiveness, and Exclusivity of the election monitoring.
