تبیین ادله اعتبار فرانسلی قانون اساسی

نوپیدایی نسلی یا تجدید نسل، امری طبیعی در جوامع انسانی و موضوعی مهم در جامعه‌شناسی جمعیت است. از سوی دیگر، «تداوم اعتبار قانون اساسی» در جامعه به‌دلیل جایگاه برتر شکلی و ماهوی این قانون و کارکرد مهم آن در نظام حقوقی سیاسی، اجتناب‌ناپذیر به‌نظر می‌رسد. در خصوص تاثیر تغییر نسل بر اعتبار قانون اساسی مباحث مختلفی در گرفته است؛ چنانچه قانون اساسی، «فرانسلی» باشد، با هر مبنای مشروعیتی در طول نسل‌های متمادی، معتبر و پایا نگاه داشته می‌شود. در عین حال برخی حقوقدانان به «اعتبار نسلی قانون اساسی» معتقدند و ادله متفاوتی در این خصوص مطرح کرده‌اند که اغلب دائرمدار حق تعیین سرنوشت و حاکمیت ملی است. این مقاله با استفاده از روش توصیفی تحلیلی، ضمن طرح و ارزیابی مبانی نظریه نسلی بودن، به توجیه حقوقی اعتبار فرانسلی قانون اساسی می‌پردازد. «استمرار هویتی نسل» و «استمرار ماهیتی قانون اساسی» در کنار استناد به «قواعد فقهی حقوقی اثباتی»، یافته‌های پژوهش حاضر و تبیین‌کننده اعتبار فرانسلی قانون اساسی به‌عنوان امری شایسته و بایسته بیان شده‌اند. بدیهی است که پویایی و تقویت قانون اساسی امری معقول و مشروع بوده و از موضوع نوشتار حاضر خارج است.

Explaining the Reasons for the TransGenerational Validity of the Constitution

Natural in human societies and important in population sociology is generation renewal. On the other hand, the continuation of the Constitutional validity in society is inevitable and defensible due to the supreme status of the Constitution, Formally and substantially, and its important function in the political legal system. Renewal of the Constitution and continuity of its validity raises various questions; if transgenerational, it would be valid and constant during different generations by any basis of legitimacy. At the same time, some scholars believe in the generational validity of the Constitution and have put forward different arguments generally with the focus on the right to selfdetermination and national sovereignty. Using a descriptiveanalytic approach, this paper, while designing and evaluating the foundations of the theory of generativity, explores the legal justification of transgenerational validity of the Constitution. The continuity of generational identity and substantive continuity of the Constitution along with citation to positive legal jurisprudence rules, are findings of the present study which explain the transgenerational validity of the constitution as appropriate. Obviously, the dynamism and strengthening of the Constitution as a legitimate and reasonable issue is beyond the scope of this article.
