پست مدرنیسم و بازاندیشی مفهوم جرم

چکیدهنقطه آغاز مسیرِ اندیشه کیفری است. درواقع ، تصویری که از جرم « جرم » ترسیم مفهوماختیار می شود، سایر مفاهیم بنیادین جرمشناختی (نظیر مجرم و علت شناسی) و نیز مفاهیمبنیادین نظام سیاست گذاری کیفری (نظیر عدالت، جرمانگاری و پیشگیری) را صورت بند یمی کند. به این دلیل، مقاله حاضر درصدد است مفهوم جرم را در چارچوب دو پارادایم متمایزمدرنیسم و پست مدرنیسم به بحث گزارد. در این راستا، ایده محوری مقاله این است که اگر درپنداشت مدرنیستی جرم با پیش فرض ماهیت عینی یا معنای ذاتی (از درون ) تصویر م ی شود ،خوانش پست مدرن آن را با ماهیت ذهنی یا معنای اکتسابی (از بیرون) جایگزین می کند. جهتشرح این ایده، ابتدا انگاره های پست مدرنیسم معرفی می شود. سپس پنداشت مدرنیستی از جرمارائه « جرم شناسی تاسیس ی » نقد و آسیب شناسی می شود و نهایتاً تعریف نوینی از جرم از منظرمی شود. به رغم اهمیت پیش گفته، این تقابل مفهومی جرم، ه یچ گاه در ادبیات جرم شناس یپارسی موردبررسی قرار نگرفته است.

Postmodernism and Rethinking the Conceptof Crime

AbstractDefining the concept of crime is the starting point in the criminalthought. Basically, any view taken on the concept of the crime formulates theother fundamental criminological concepts (such as the criminal andetiology) as well as basic concepts of criminal policy system (such as justice,criminalization and prevention). In the light of the foregoing, we attempt todiscuss the concept of the crime in the framework of two distinct paradigmsof modernism and postmodernism. That said, we argue that while themodernist reading conceives the crime with the presumption of the objectivenature or inherent meaning, the postmodernist reading, on the contrary,replaces this presumption with the subjective nature or acquired meaning. Inorder to develop this thesis, the ideas of postmodernism will first beintroduced. Subsequently, a critique of the modernist view of the crime willbe offered. Eventually, a new definition of the crime from the perspective ofthe constitutive criminology will be provided. Despite the abovesaidimportance, this analysis of the meaning of the crime has never been touchedupon in the Persian literature of criminology.
