گفتمان قدرت و دانش در تحلیل مجازات مدرن

یکی از روش ‌های تحلیل مجازات مدرن با تمرکز بر مولفۀ قدرت است. بسته به نوع تعبیر از قدرت، روش‌ها و نتایج تحلیل‌ها متفاوت می‌شوند. میشل فوکو به هدف تحلیل مجازات مدرن، با تعبیر نیچه‌ای قدرت، آن را به مثابۀ نسبت نیرو محسوب کرد و از روش‌ تبارشناسی نیچه‌ای برای تحلیل خود بهره برد. فوکو معتقد به وجود قدرت در همه جا و رابطۀ همبستگی‌اش با دانش بود؛ او برای تبارشناسی ازگفتمان قدرت و دانش استفاده کرد؛ که بدیع اما چالش‌برانگیز بود. گفتمان مذکور، شاید بیش از آنکه به دنبال پاسخی برای مسئله‌ها باشد، به پرده‌برداری از برخی اسرار مجازات مدرن پرداخت. به‌این‌ترتیب، رهگذر پرسش‌های متعددی شد؛ از مفهوم گفتمان قدرت و دانش تا فایدۀ آن در تحلیل مجازات مدرن و حتی زمان‌مندی و یا فرازمانی بودنش. مقالۀ جاری با روش توصیفی-تحلیلی سعی بر پاسخ به سه پرسش اصلی بیان شده دارد. در نتیجه، عدول فوکو از تعابیر رایج قدرت، اغراق وی در برخی تبارشناسی‌هایش و برخی ناگفته‌های وی شاید منجر به منقضی محسوب کردن سبک او بشوند، اما نگاه پیشگیرانۀ او در حوزۀ مجازات مدرن و تاکید ضمنی‌اش بر پیچیدگی مجازات، شاید راهی برای ماندگاری روش وی رقم می‌زند.

the discourse of power and science in the analysis of modern punishment

although one of the selected methods to analysis modern punishment is focusing on power; but this option was exposed to different interpretations by thinkers. because the design of this model of punishment was rooted in the modern society and the different needs of it and of course the answers with the pre-modern society. for example, they went for new and more complicated methods to control crime and claimed to improve the situation compared to public punishments; so that, they can walk victoriously in the path of successful crime control. the origin of this change in punishment was mostly based on protests that was expressed about haw to carry out public punishments that couldn't help the criminal justice system in reducing crime as expected. the highest form of it was the prison which in a way became the upper limit of the implementation of discipline. consideration that the prison itself is an independent society from the outside and on the other hand a disciplinary method was chosen for it, two ambiguities arose from the prison and the disciplinary method at the same time. this situation caused more or less questions about the reason for choosing a disciplinary style, from choosing to breaking down its components.
