جرم اسید پاشی در بستر تحولات قانونی با نگاهی به « قانون تشدید مجازات اسید پاشی و حمایت از بزه دیدگان ناشی از آن مصوب 1398»

اسید پاشی در بیشتر نظام های حقوقی به عنوان یک پدیده ضد اجتماعی جرم انگاری شده و برای مرتکب آن، مجازات های سنگینی پیش بینی شده است. با توجه به آسیب شدید به نظم اجتماعی و بزه دیدگان این جرم، علاوه بر افزایش بازدارندگی کیفر، حمایت از بزه دیدگان از اهمیت بسزایی برخوردار است. این نوشتار در راستای ارزیابی تدابیری است که به منظور کاهش میزان ارتکاب جرم اسیدپاشی و نیز حمایت از بزه دیدگان به موجب « قانون تشدید مجازات اسیدپاشی و حمایت از بزه دیدگان ناشی از آن مصوب 1398» پیش بینی شده است. این پژوهش، با استفاده از روش توصیفی-تحلیلی، ضمن اشاره به سابقه قانونگذاری جرم اسیدپاشی و ارکان تشکیل دهنده آن به تاثیر افزایش کیفر، ممنوعیت نهادهای ارفاقی و تدابیر پیشگیرانه بر کاهش ارتکاب جرم می پردازد. همچنین، بر لزوم ارائه راهکارهای حمایتگرانه جسمی و روانی نسبت به بزه دیدگان که در قوانین پیشین مغفول مانده بود تاکید می کند. این نوشتار نتیجه می گیرد هرچند قانون مصوب در جهت تشدید کیفر اسیدپاشی و پیش بینی جنبه های حمایتگرانه گام های مثبتی برداشته است، لیکن اتخاذ تدابیر پیشگیرانه بیشتر، به ویژه پیشگیری وضعی نظیر احراز هویت خریداران اسید و ثبت تمام معاملات مربوط به آن ضروری است.

the offence of acid attack in the context of new legal developments with special reference to the iranian aggravation of punishment of acid attack and support of its victims act 2019

acid attack, as an anti-social behaviour, is a serious crime with severe punishment under legal systems.the severe damage caused to the public order, and the harm caused to the victims necessitates severe punishment imposed on the the perpetrator and supportive measures provided for the victim.this paper examines the measures taken by the newly enacted law in attempt to prevent the commission of this heinous crime and to support victims.by adopting a descriptive and analytical method, this paper considers the legislative background of this crime, and examines its constituent elements under the new law.it examines the effect of aggravation of punishment, prohibition of applying leniency institutions, aggravation of abettor’s punishment and adoption of preventive measures in reducing the occurrence of this crime. the paper emphasizes the need to provide physical and psychological support to the victims, which was not provided in previous legislation.the conclusion is that, in spite of the positive steps taken in the newly enacted law, in the sense of increasing the punishment, and providing supportive measures , further measures are still needed to ensure the prevention, and especially situational prevention of this crime such as identification of acid buyers and registration of such transactions.
