روابط معنا-نماد و الهیات مجازات: پدیداری آیین تعذیب

مطالعات فنّی حقوق کیفری کمتر به بحث در خصوص جلوه‌‌های اجتماعی پدیدار مجازات می‌‌پردازند. مقصود از این جلوه‌‌ها پیوندهای ناگسستنی و اغلب پنهانی است که مجازات با سایر پدیدارهای اجتماعی برقرار می‌‌کند. مجازات بخشی از ساختار نظام اجتماعی است و به همین ‌‌واسطه، تولّد و دگرگونی پدیدار کیفر ارتباطی ناگسستنی با سایر بخش‌های این ساختار دارد. تعذیب نیز از این قاعدة فراگیر مستثنی نیست. تولّد و تداوم حیات این «کیفرهای مناسک‌‌گونه» ارتباطی پیچیده با سایر پدیدارهای اجتماعی دارد. با وجود این، مطالعات مرسوم و فنّی حقوق کیفری تمایلی بسیار اندک برای پرداختن به پیوندهای پنهان مناسک تعذیب با پدیدارهای اجتماعی دارند. در این قبیل مطالعات، اغلب، تعذیب به مثابة جلوه‌‌ای آشکار از بربریّت کیفری پنداشته می‌‌شود. در تقابل با تصویری که مطالعات فنّی از تعذیب ارائه می‌‌دهند، جامعه‌‌شناسی کیفر نشان می‌‌دهد که این مناسک رنج‌‌بنیاد چیزی فراتر از نمایش‌‌هایی ساده برای تحمیل رنج بدون مرز و چیزی فراتر از یک بربریّت کیفری هستند. ملاحظات جامعه‌‌شناختی به اثبات می‌‌رسانند که آیین‌‌های پر رمز و راز تعذیب پیوندهایی پنهان با نظام معانی، حسّاسیّت‌‌ها و نیز هویّت وجدان جمعی برقرار می‌‌کنند.

Meaning-Symbol Relations and the Theology of Punishment: The Emergence of Rituals of Torture

AbstractTechnical studies of criminal law rarely discuss the social aspects of punishment. Punishment has a deep relation with other social institutions such as power, culture and punishment is part of the social structure. As a result, this phenomenon has close relation with other parts of social structure. Torture, as one shape of penal reaction, is no exception to this pervasive rule. Birth and continuation of these ritual punishments have complex and deep relations with other social phenomena. However, technical studies of criminal law are reluctant to examine the hidden sociological aspects of torture.  The Sociology of punishment tries to show thesehidden relations. Sociological study shows that torture has a deep relation with the identity of the collective conscious.
