جایگاه پلی‌‌گرافی در نظام ادلّه کیفری ایران

طی سال‌‌های اخیر استفاده از فناوری دروغ‌‌سنجی مورد توجّه برخی نظام‌‌های حقوقی در جهان قرار گرفته است. هر چند عدّه‌‌ای با این استدلال که بکارگیری این فناوری با حقّ سکوت متّهم در تعارض است و کرامت انسانی را مخدوش نموده و حریم خصوصی افراد را زایل می‌‌کند آن را نپذیرفته‌‌اند، علیرغم ایرادات و چالش‌‌های موجود در این زمینه، می‌‌توان پلی‌‌گرافی را به عنوان یک دلیل علمی به منظور اثبات مجرمیّت یا برائت متّهم مورد عنایت قرار داد و با اصلاح قانون آن را در شمار دیگر ادلّه قانونی اثبات دعوای کیفری قلمداد کرد. همچنین، در صورت پیروی از نظام دلایل معنوی، از آنجا که مقام قضایی در تحصیل دلیل کیفری فعّال عمل می‌‌کند و هر آنچه او را به قطع و یقین برساند ولو مخالف با دلایل قانونی باشد، مبنای تصمیم‌‌گیری او واقع می‌‌شود، یافته‌‌های حاصل از پلی‌‌گرافی می‌‌تواند به عنوان قرینه یا مستند بیّن در حصول علم برای قاضی عمل کنند و به این نحو با ارزیابی سایر دلایل صحّت و سقم آنها را معیّن نموده تا با مکانیزه کردن آنها مقام قضایی را در اتّخاذ تصمیمی صحیح یاری نماید.

The Place of Polygraph in Iran’s Criminal Evidence System

In recent years, utilizing polygraph technology has drawn the attention of some legal systems in the world. However, some individuals have refused to accept it by arguing that using this technology is in conflict with the defendant’s right to remain silent, which violates human dignity and interferes with people’s privacy. Despite the proposed disadvantages and the existing challenges in this area, polygraphs can be regarded as scientific evidence to prove the culpability or innocence of the defendant, and by amending the law, it can be considered as another legal evidence to prove a criminal case. In addition, by taking into account the system of spiritual reasons, the legal authorities operate actively in obtaining legal evidence and use whatever reason that makes them certain about a case (even if they contradict legal evidence) and bases their decisionmaking process on such evidence. Polygraph results can serve as supporting evidence or substantial evidence to offer a judge the necessary information to issue the right verdict, and thus, by evaluating other proofs, it can determine their precision and validity to systematize them to help the judicial authorities with making the right decision.
