هستی شناسی اصول بنیادین دادرسی کیفری

اصول بنیادین در هر نظام حقوقی زیرساخت ها و پایه های هر نظام حقوقی را می سازند. بر این اساس، اصول بنیادین دادرسی، اصول کلی و دائمی هستند که ریشه در حقوق اساسی و بنیادینی دارند که وجود آن ها باعث پایندگی و دوام و نبود آن ها موجب از هم گسیختگی حیات دادرسی و مشروعیت آن می گردد. این اصول مفاهیمی فراقانونی است که به عنوان میراث نسل‎های گذشته مورد پذیرش وجدان عمومی قرار گرفته و امروزه به عنوان مسلمات حقوق نیازی به اثبات ندارند. وجود این اصول، عقلانیت و انسجام ساختار حقوقی را تضمین کرده و فقدان آن، موجب آشفتگی و بی‎نظمی حقوقی می‎شود. این اصول که ریشه در اعتقادات و باورهای آن نظام، یافته‎ها و آموزه‎های حقوق بشری، حقوق داخلی و اسناد بین‎المللی دارند، در قلمرو آیین دادرسی کیفری، اهمیتی دوچندان می‎یابند؛ زیرا آیین دادرسی کیفری درصدد آشتی میان آزادی و امنیت است و بدیهی است اصول بنیادین حاکم در این مرحله باید از یک طرف، تامین کننده حقوق فردی در مفهوم خُرد و حقوق بشر در مفهوم کلان بوده و از سوی دیگر، تضمین کننده امنیت شهروندان و جامعه باشد.
