بررسی تطبیقی دادگاه های ویژه مبارزه با مفاسد اقتصادی ایران با تاکید بر اصل حتمیت اجرای مجازاتها

تردید در توانایی سیستم قضایی عادی جهت مبارزه با فساد و نگرانی در رسیدگی بی طرفانه و بیم نفوذ ناروا، بسیاری از کشورها را وادار به ایجاد موسسات تخصصی و دادگاههای ویژه مبارزه با فساد کرده است. افزایش حتمیت اجرای مجازاتها دلیل عام ایجاد دادگاههای مذکور است و از دلایل خاص می توان به افزایش بهره وری، یکپارچگی و تجربه و تخصص اشاره کرد. در کشورهای دنیا یک مدل ثابت و استانداردی برای دادگاه های ویژه مبارزه با فساد وجود ندارد و بسته به شرایط کشورها و نیازهای آنها به تخصص، در سلسله مراتب قضایی مدلهای گوناگونی مشاهده می شود. بعضی از کشورها فقط نوعی قاضی ویژه پیش بینی کرده اند و بعضی کشورها دادگاههای ویژه بدوی مجزا طراحی کرده اند و برخی دیگر، دادگاههای ترکیبی ایجاد کرده اند که در پاره ای موارد به عنوان دادگاه بدوی عمل می کنند و در موارد دیگر به عنوان دادگاه تجدیدنظر رسیدگی می کنند. و نهایتاً در بالاترین حد پاسخ به تخصص، بعضی از کشورها سیستم دادگاههای ویژه جامع که هم عرض سیستم عادی قضایی است، ایجاد کرده اند. هرچند دادگاه های ویژه مبارزه با مفاسد اقتصادی ایران در نحوه تشکیل خاص هستند، لکن با مدل های جهانی وجوه اشتراک متعددی دارند.

Comparative Study of Specialised anticorruption courts in Iran Underlining the principle of the certainty of the execution of the penalties

The uncertainty surrounding the ability of the ordinary justice system to fight corruption and the concern for impartial treatment and fear of intrusive influence have forced many countries to establish SpecialisedAntiCorruptionInstitutions and specialised anticorruption courts. The general reason for the establishment of specialised anticorruption courts is to increase the certainty of the execution of the penalties and the special reasons are to increase the efficiency, integrity and experience. In the countries through the world, there is no standardized model for specialized anticorruption courts, and there are various models in the judicial hierarchy depending on the countries' requirements and their needs for expertise. Some countries have only foreseen a special judge, and some countries have developed special courts of special primacy, while others have established Hybrid courts that in some cases act as court of first instance and in other cases as appellate courts. And ultimately, at the highest level of the response to the expertise, some countries have created a system of comprehensive special courts, which is also the width of the ordinary judicial system. Although the Specialised anticorruption courts in the Islamic Republic of Iran are specific in their formation, they have many share points to global models.
