هرزه نگاری سایبری: از مبانی نظری تا الگوهای واکنش کیفری

با گسترش فناوری‌های نوین، هرزه‌نگاری سنتی که در اشیاء فیزیکی خود را نشان می‌داد، وارد فضای مجازی شد و سرعت گسترش آن چشمگیر شد. هرزه‌نگارها از هر پیشرفتی برای تولید و توزیع پورنوگرافی بهره گرفتند. آن‌ها در صنعت چاپ از لیتوگرافی و عکاسی استفاده کردند. از فناوری‌هایی شامل چاپ فشاری، عکاسی، تلویزیون ماهواره‌ای، اشکال مختلف ویدئو و اینترنت استفاده کردند به گونه‌ای که دولت‌ها وادار شدند برای مبارزه با آثار مخرب آن در جامعه دست به کار شوند. مرحله نخست، شکل دادن مبانی نظری استواری برای مبارزه با هرزه‌نگاری بود. دولت‌ها با استفاده از مبانی دینی و اخلاقی، نظریه‌هایی در تقبیح هرزه‌‌نگاری یافته، آن‌گاه از طریق مبانی حقوقی و جر‌مشناختی، به وضع مقرراتی در این حوزه پرداختند و البته از مدل‌های گوناگونی برای واکنش کیفری در برابر این پدیده استفاده کردند که شامل منع مطلق در تولید محتوا و دستیابی به محصولات هرزه‌نگاری تا اجازه‌ محدود در تولید محتوا و دسترسی افراد به محصولات هرزه‌نگاری می‌شود.

Cyber Pornography: from Theoretical Viewpoint to Models of Criminal Action

Pornography existed before the creation of the Internet. It is not possible to say whether the advent of the Internet has fuelled the demand for pornography and expanded an existing market, or whether it simply satisfies in new ways a market that would have existed in any event. It is clear, though, that the Internet provides an environment for the proliferation of child pornography and the creation of an expanding market for its consumption. The Internet has increased the range, volume and accessibility of sexually abusive imagery, including child pornography. Child pornography depicts the sexual or sexualized physical abuse of children under 16 years of age. Some countries has joined many other nations in an international effort to combat this multifaceted global menace that combines both heavily networked and highly individualized criminal behavior. This paper examines the typology of pornography offending, as well as law enforcement responses to the problem.
