رهیافت های پیش نگرانه در مهار تروریسم

ناکارآمدی رویکردهای مجازات‌محور پس از وقوع حملات تروریستی در پیشگیری از این پدیده‌‌ی مجرمانه، به گسترش راهبردهای نوین کنترل تروریسم از رهگذر سازوکارهای پیشدستانه و اتخاذ تدابیر پیشگیرانه قبل از وقوع جرایم تروریستی منجر شده است. مقاله حاضر درصدد است با استفاده از روش تحقیق توصیفی – اسنادی به این پرسش که «در راستای پیشگیری از مخاطرات زیانبار تروریسم در مرحله‌ی پیش از ارتکاب جرایم تروریستی، چه تمهیدات پیش‌نگرانه‌ای در نظام‌های حقوقی پیش‌بینی شده است؟» پاسخ دهد. یافته‌های این پژوهش نشان می‌دهد امروزه رهیافت‌های پیش‌نگر جهت مهار تروریسم جایگاه ویژه‌ای در نظام‌های حقوقی یافته و نظام‌های تقنینی با اتخاذ سازوکارهای قبل از وقوع تهدیدهای تروریستی، رویکرد آینده‌نگری را نسبت به این پدیده‌ی خطرناک اتخاذ کرده‌اند. مهم‌ترین راهبردهای پیش‌نگر در کنترل تروریسم عبارت است از تحدید مالکیت، شفافیت مالی و جلوگیری از تامین مالی تروریسم، محدودیت‌های ارتباطی، آموزشی و اشتغال، الزامات اقامتی و نظارتی، کنترل سفر و تفتیش اماکن. ضمانت‌اجرای اقدامات پیش‌نگرانه در مواجهه با تروریسم شامل اقدامات اجرایی، قرارهای کنترل و بازداشت است.

The most important Anticipatory strategies to control terrorism to include the limitation or prohibition of ownership, financial transparency and prevention of terror financing, communication, training and employment restrictions, residence and monitoring obligations , control on travelling and inspect places. Safeguards for Anticipatory measures in the face of terrorism include administrative measures, Control orders and arrest.
