نقش و جایگاه بزه‌دیده در حقوق تحقیقات جنایی

حقوقِ تحقیقات جنایی با تمرکز بر قوانین و مقررات به بحث درباره کشف جرم، شناسایی متهم، اثبات بزهکاری، شناسایی بزهدیده و تعیین میزان آسیبهای مادی و معنوی بر وی میپردازد. فرآیندهای تحقیقات جنایی با شکایت بزهدیده، اعلام مقامات رسمی و غیررسمی، اطلاع رسانی توسط اشخاص حقیقی و حقوقی، حامیان بزهدیده یا کشف جرم توسط پلیس، آغاز میگردد. چالش اصلی در این مرحله، عدم شکایت و اعلام بزهدیدگی به پلیس و نهادهای عدالت کیفری است. معاینه محلّ بزهدیدگی و بررسی صحنه جرم محورهای اصلی حقوقِ تحقیقات جنایی را تشکیل میدهد. استماع شهادت شهود، اظهارات مطلعان و گزارشات کارشناسی در کشف حقیقت و اثبات بزهکاری موثر است که همواره بخشی از مباحث حقوقِ تحقیقات جنایی را تشکیل میدهد. در گذشته حقوقِ تحقیقات جنایی بر بزهکار تمرکز داشته است، تحولات بزهدیده شناسی موجب گردید که حقوقِ تحقیقات جنایی به نقش و جایگاه بزهدیده نیز توجه نماید. این مقاله بر اساس رویکرد حمایتی از بزهدیدگان و بررسی موضوع در قلمروی بزهدیده شناسی نگارش یافته است. اهّم عناوین مورد بحث شامل؛ شروع تحقیقات جنایی و چالشهای آن، نقش بزهدیده در معاینه محلِ و تحقیقی محلّی و نقش بزهدیده در بررسی صحنه جرم میباشد

The Role of the Victim in the Criminal Investigation Rights

Abstract Criminal Investigation Rights focuses on laws and regulations to discuss crime detection, identification of the accused, proof of delinquency, identification of the victim and determination of material and moral damage to him. Criminal investigation processes begin with a victim’s complaint, the announcement of official and informal officials, information by legal and natural persons, victim supporters, or the detection of a crime by the police. The main challenge at this stage is the lack of complaints and the reporting of victim to the police and criminal justice institutions. Victimization examination and crime scene investigation are the main axis of the criminal investigation law. The testimony of intuition, testimonials, and expert reports are effective in discovering the truth and proving criminal misconduct, which is always part of the topic of criminal investigation rights. In the past, the law of criminal investigations focused on delinquent, victim studies have caused criminal investigations to pay attention to the role of the victim.
