چالش‌ های حقوقی فرماندهی مرزبانی در مبارزه با قاچاق کالا مطالعه موردی: استان کردستان

زمینه و هدف: به ‌طور کلی یکسری از مسائل و مشکلات پیشِ روی مقابله با قاچاق و مصادیق آن، توسط نهادهای ذی‌ربط، چالش‌های مختلف حقوقی بشمار می‌رود. ازاین‌رو، هدف از انجام پژوهش حاضر، شناخت چالش‌های حقوقی مرزبانی در اجرای ماموریت مبارزه با قاچاق کالا با تاکید بر استان کردستان است.روش: پژوهش حاضر از حیث نوع دستاورد، کاربردی و برحسب روش پژوهش از نوع مطالعات کیفی توصیفی- تحلیلی بود. تحلیل داده‌ها از طریق مصاحبه با تعداد 17 نفر از کارشناسان به‌صورت تحلیل مضمون انجام گرفت. جامعه آماری شامل کارشناسان حقوقی و مرزبانی بود. نمونه‌گیری به‌صورت هدفمند و به شیوه گلوله برفی انجام شد.یافته‌ها: یافته‌های پژوهش حاضر حاکی از وجود چالش‌های حقوقی فرماندهی مرزبانی فراجا در پیشگیری و مقابله با قاچاق در سه بخش «چالش‌های قانونی»، «چالش‌های قضایی» و «چالش‌های اجرایی» بود که به میانجی مصاحبه با کارشناسان منتخب، احصا گردید.نتایج: نتیجه پژوهش حاکی است چالش‌های قانونی عبارت‌اند از: «ضعف در عنصر قانونی جرم تردد غیرمجاز از مرزها»، «ابهام دستورالعمل‌های حریم امنیتی مرز «، «خلاء تعیین حق السهم سازمان‌ها در رسیدگی به امورات مرز»، چالش‌های قضایی عبارت‌اند از: «برخورد ضعیف قضایی با نقض حریم امنیتی مرز»، «عدم پشتیبانی و حمایت قضایی از ماموران مرزبانی»، «عدم استفاده قضات از کارشناسان و متخصصان در پرونده‌های قاچاق» و چالش‌های اجرایی عبارت‌اند از: «مسئله نقض حریم امنیتی مرز»، «ضعف در زیرساخت‌های اقتصادی و رفاهی منطقه»، «کنترل یک‌جانبه مرز»، «عدم تعامل مناسب سازمان‌های ذی‌ ربط»، «ضعف آموزشی ماموران مرزی»، «عدم به‌کارگیری منسجم فناوری ‌های نوین در مرز».

the legal challenges of the border guard command in the fight against goods smuggling: the case study of kurdistan province

background and aim: in general, the relevant institutions consider a series of issues and problems facing smuggling and its examples various legal challenges. therefore, the purpose of the present research is to understand the legal challenges of the border guard in implementing the mission of combating the smuggling of goods with an emphasis on kurdistan province.methodology: in terms of the type of achievement, the present research was applied, and according to the research method, it was a descriptive-analytical qualitative study. data analysis was done through interviews with 17 experts in the form of thematic analysis. the statistical population included legal experts and border guards. sampling was done purposefully and using the snowball method.results: the findings of the current research indicated the existence of legal challenges for the border guard command in preventing and dealing with smuggling in three sections: legal challenges, judicial challenges, and executive challenges, which were counted through interviews with selected experts.conclusion: the result of the research indicates that the legal challenges are weakness in the legal element of the crime of illegal movement across the borders, ambiguity of the border security regulations, and vacuum in determining the rights of organizations in dealing with border affairs. judicial challenges include weak judicial response to violations of border security, lack of judicial support and support for border guards, and judges not using experts and specialists in smuggling cases. the implementation challenges include the problem of violation of border security, weakness in the economic and welfare infrastructure of the region, unilateral control of the border, lack of proper interaction of the relevant organizations, weakness of training of border agents, lack of consistent employment new technologies at the border.extended abstract: introductionorder and security are an integral and necessary part of human life and one of the main functions of governance in society. identifying the factors disrupting the security of the society, especially at the borders, will help to realize this important function. today, border areas are one of the most important national and international issues. border areas are the place of various developments that have a direct impact on the political, military, economic, social and cultural situation of a country. none of the government’s development plans will be realized unless the country’s borders are carefully controlled and guarded. on the other hand, smuggling of goods causes irreparable damage to the country’s economic system by creating obstacles in productive investments, weakening healthy commercial competition, and eventually forming and expanding the underground and hidden economy. an increase in the rate of smuggling of goods causes a decrease in investment in production, the destruction of employment, an increase in the unemployment rate as a result, and the spread of poverty in the society.
