استانداردسازی حقوق «بزه دیدگان مرزی» در عملیات تروریستی

زمینه و هدف: در سایه مبارزه جدی با تروریسم، لزوم حمایت از حقوق بزه دیدگان جرائم تروریستی مرزنشین که واقعاً می‌توان از آن‌ها به «سربازان بی‌دفاع» تعبیر نمود، امری انکارناپذیر است «نوع و آسیب‌پذیری» بزه دیدگان تروریسم به گستره «اهداف تروریست‌ها» در فرآیند کشف جرم برای مقامات پلیسی و یگان‌های مرزبانی آن‌هم در نقاط حاشیه نوار مرزی که به‌سرعت احتمال فرار تروریست‌ها به آن‌سوی مرزها متصور است دارای اهمیت فراوانی است. هدف احصاء موازین حقوقی مرتبط با کرامت انسانی و کاهش خسارات وارده بربزه دیدگان تروریسم مرزنشین در نظام حقوقی کشورهای موردمطالعه به‌منظور «استانداردسازی حقوق این دسته از مرزنشینان به‌عنوان بخشی از شهروندان در نظام حقوقی ایران» در فرآیند مقابله با تروریسم است.روش: پژوهش حاضر از نظر ماهیت موضوع «بنیادی نظری»؛ از حیث هدف «کاربردی» و روش انجام آن «توصیفی- تحلیلی» بوده و داده‌های موردنظر به روش اسنادی گردآوری‌شده است. در این راستا برای استخراج داده‌های موردنیاز با روش فیش‌برداری از منابع داخلی و خارجی؛ داده‌های موردنظر در راستای اهداف پژوهش دسته‌بندی گردیده و با رویکرد تفسیری مورد تجزیه‌وتحلیل قرارگرفته است.یافته‌ها: بیشترین فراوانی بزه دیدگی بزه دیدگان مرزی؛ ناشی از حملات مکرر تروریست‌ها؛ به‌واسطه دسترسی آسان و در معرض قرار گرفتن جغرافیایی این قبیل از بزه دیدگان در مسیر ترانزیت آن‌ها است.نتایج: تثبیت مدون و قانونمند حقوق این دسته از شهروندان؛ مستلزم احصاء مصادیق خلاءهای حقوقی آن‌ها در نظام‌های پیشرو در مقابله با تروریسم و در نهایت استانداردسازی تقنینی و اجرایی در نظام حقوقی ایران به‌منظور تقلیل میزان بزه دیدگی مرزنشینان است.

standardizing the rights of border victims in terrorist operations

background and aim: in the shadow of the serious fight against terrorism, the need to protect the rights of the victims of border terrorist crimes, who can be interpreted as defenceless soldiers, it is undeniable that the type and vulnerability of the victims of terrorism is related to the targets of terrorists. in the process of crime detection, it is very important for the police authorities and border guard units in the peripheral areas of the border strip, where the possibility of terrorists fleeing to the other side of the border is considered fast. the purpose of calculating the legal standards related to human dignity and reducing the damages caused to the victims of borderline terrorism in the legal system of the studied countries is to standardize the rights of this group of borderline residents as part of the citizens in iran's legal system in the process of dealing with terrorism.methodology: the current research is based on the nature of the theoretical foundation topic; in terms of the applied purpose and the method of doing it, it is descriptive-analytical and the desired data is collected by documentary method. in this regard, to extract the required data with the method of phishing from internal and external sources; the desired data have been categorized in line with the objectives of the research and have been analyzed with an interpretative approach.results: the highest frequency of victimization among border victims; caused by frequent terrorist attacks; due to the easy access and geographical exposure of such victims in their transit route.conclusion: codified and legal establishment of the rights of this category of citizens; it requires the enumeration of examples of their legal gaps in the leading systems in dealing with terrorism and finally the legislative and executive standardization in iran's legal system to reduce the amount of victimization of border residents.
