معاضدت‌های قضایی، اطلاعاتی و پلیسی در مقابله با قاچاق انسان و مهاجران غیرقانونی در مرزها با نگاهی به موافقت‌نامه‌های امنیتی ایران با سایر کشورها

جرائمی از قبیل قاچاق انسان و همچنین قاچاق مهاجران به‌منظور عبور غیرقانونی از مرزها، جرائمی فرامرزی و جهانی هستند. مقابله با این جرائم مستلزم همکاری و هماهنگی میان کشورها و به‌ویژه کشورهای هم مرز و مجاور می‌باشد. موافقت‌نامه‌های امنیتی منعقده بین کشورها گام مهمی در جهت مقابله با قاچاق انسان و مهاجران می‌باشد. این تحقیق با هدف مطالعه و یافتن راه‌های همکاری موثر کشورها در اجرایی کردن موافقت‌نامه‌های امنیتی در پرتو این‌گونه بزه می‌باشد؛ ازجمله اینکه دو کشور باید روابط سیاسی کارآمد و بدون تنشی داشته باشند. روش توصیفی _تحلیلی که بامطالعه اسناد و موافقت‌نامه‌های امنیتی و متون کنوانسیون‌های بین‌المللی، سپس مقایسه تحلیلی مفاد این اسناد و نقاط قوت و ضعف هریک پرداخته‌شده است. یافته‌های به‌دست‌آمده نشان می‌دهد که دولت‌ها با پذیرش تعهد به جرم‌انگاری قاچاق انسان در کنوانسیون‌های مربوطه امکان برخورداری از یک رژیم ممنوعیت جهانی را مهیا کرده و در تلاش هستند تا به یک سیاست جنایی مشترکی دست یابند. همچنین همکاری دو کشور در راستای اجرا و اعمال موافقت‌نامه امنیتی مستلزم انعقاد برخی موافقت‌نامه‌های مکمل در این زمینه می‌باشد. نتایج پژوهش حاضر حاکی است که مبارزه موثر با جرم قاچاق انسان و قاچاق مهاجران به‌عنوان یکی از مصادیق جرائم سازمان‌یافته فراملی، مستلزم همکاری‌های فنی، آموزشی، تحقیقاتی، مرزی، پلیسی و اطلاعاتی بین کشورها می‌باشد و صرف انعقاد این موافقت‌نامه‌ها کفایت نمی‌کند و لازمه حسن اجرای این معاضدت‌ها در سطح بین‌المللی؛ ایجاد روابط حسنه دیپلماتیک با کشورهای دیگر و هم‌جوار می‌باشد.

judicial, intelligence and police assistance in combating human trafficking and illegal immigrants with a look at iran’s security agreements with other countries

crimes such as human trafficking and the smuggling of migrants to illegally cross borders are transboundary and global crimes. dealing with these crimes requires cooperation and coordination among countries, especially neighboring countries. the security agreements concluded between countries are an important step in the direction of dealing with human and migrant trafficking. this research aims to study and find effective ways for countries to cooperate in implementing security agreements in the light of this kind of crime; including that the two countries should have efficient and tension-free political relations. descriptive method - an analysis that is done by studying security documents and agreements and texts of international conventions, then analytically comparing the contents of these documents and the strengths and weaknesses of each. the obtained findings show that by accepting the obligation to criminalize human trafficking in the relevant conventions, the governments have provided the possibility of having a global prohibition regime and are trying to achieve a common criminal policy. also, the cooperation of the two countries in the direction of the implementation and application of the security agreement requires the conclusion of some complementary agreements in this field. the results of the current research indicate that the effective fight against the crime of human trafficking and migrant smuggling, as examples of transnational organized crime, requires technical, educational, research, border, police, and intelligence cooperation between countries, and merely concluding these agreements is not enough and requires good implementation. these grants at the international level; establish good diplomatic relations with other and neighboring countries.
