واکاوی مفهوم «استفادۀ منصفانه» در هنر معاصر با بررسی پرونده‌های حقوقی جف کونز و ریچارد پرینس

این مقاله در پی آن است تا با بررسی گونه‌های متکی بر کپی در هنر معاصر، چگونگی انطباق آنها با قانون مالکیت فکری را بررسی کند. در این راستا، با بررسی موردی پرونده‌های »ازآن‌خودسازی « و معیارهای دکترین استفاده منصفانه در آن‌ها، حدود و صغور کپی قانونی و خلاقانه تعیین می‌شود. پرسش اصلی پژوهش حاضر این است که چگونه استفاده منصفانه به عنوان یک راه‌حل حقوقی در بروز خلاقیت بیشتر به هنرمندان کمک می‌کند؟ فرضیه مقاله این است که استفاده منصفانه راه‌حل میانجی حقوق و هنر برای به تعادل رساندن سخت‌گیری قوانین کپی‌رایت است. از این‌رو، پرونده‌های هنرمندانی چون جف کونز و ریچارد پرینس به عنوان موارد تاثیرگذار در تاریخ هنر و حقوق انتخاب شده و معیارهای استفاده منصفانه در آن‌ها استخراج و تحلیل می‌شوند. روش پژوهش مقاله حاضر، روش پژوهش رهنامه‌ای است که در آن با استفاده از آرای دادگاه‌ها و بررسی پرونده‌ها تحولات قوانین کپی‌رایت متناسب با ویژگی‌های هنر معاصر بیان می‌گردد. نتایج تحلیل پیش »رو، نشان می‌دهد که استفاده منصفانه با در نظر گرفتن معیارهایی نظیر پارودی و تغییر شکل بیش از هر چیزی در پی دفاع از بیانگری و بروز خلاقیت هنرمند است. همچنین، بررسی عملکرد دادگاه‌ها به روش پژوهش رهنامه‌ای نشان می‌دهد که بروز خلاقیت هدف مشترک قانون مالکیت معنوی و هنر معاصر است.

Investigating the “Fair Use” in Contemporary Art in the Cases of Jeff Koons and Richard Prince

This article explores how copyrightbased genres in contemporary art conform to intellectual property law. By examining the ldquo;appropriation rdquo; cases and the criteria of the doctrine of fairuse in them, the limits and borders of legal and creative copying (reduplication?) are determined. This study rsquo;s main question is how fairuse as a legal solution helps artists to be more creative? The research hypothesizes that fairuse is the mediating solution of law and art to balance copyright laws strictness. The cases of Jeff Koons and Richard Prince, as examples of influential figures in the history of art and law, have been selected, and the criteria for their fairuse will be analyzed. The Research Method is a doctrinal research method in which the evolution of copyright laws following contemporary art characteristics is expressed through court decrees and reviewing cases. The present analysis results show that fairuse, by considering parody and Transformative use, defends the expression and appearance of the artist rsquo;s creativity. Further, the study of court rsquo;s performance through doctrinal research method shows that the emergence of creativity is a common goal of intellectual property law and contemporary art.
