امداد و نجات مقولهای است که در بسیاری از سفرهای دریایی رخ میدهد، در این عملیاتخطیر مسائل مختلف فنی و حقوقی ایجاد میشود. شناورهایی که جهت انجام این عملیات عازممیشوند معمولاً خود در حال انجام کار دیگری میباشند که با این کار باعث نقض قراردادهایکاری خود میشوند. کشتیهای امدادگر از این بابت و نیز برای انجام کار امداد و نجات معمولاًهزینه زیادی را متحمل میشوند. خسارات مختلفی که ایشان متحمل میشوند همچنین خساراتیکه ممکن است ایشان به امداد جو وارد کنند همواره مورد مناقشه بوده است . امدادرسانی وظیفهقانونی فرمانده کشتیها میباشد اما برای جبران هزینه ها و خسارات وارده نیز باید راه منطقی ومنصفانهای در نظر گرفت. این کار ممکن است برای دست یافتن به سود اقتصادی و یا یک عملاخلاقی از روی احسان باشد. در این نوشتار نخست مبحث امداد و نجات و الزامات قانونی آنبراساس کنوانسیونهای بینالمللی و حقوق کامنلا و حقوق موضوعه و قوانین جمهوری اسلامیایران تشریح شده و سپس به راههای جبران هزینههای احتمالی از دیدگاه سیستم های ذکر شدهپرداخت شده است.

Salvage under Common Law and Salvage Convention

Rescue and salvage operations take place in many sea voyages. Numeroustechnical and legal problems may arise in these operations. The vessel whichproceeds to do this operation normally performs another job. By this operation,the vessel breaches her job contract. The rescue ships usually incur a lot of costsand damages in order to perform rescue operation. There are always manychallenges regarding costs and damages of rescuer in addition to the damageswhich the vessel may cause to the rescued ship. The rescue operation is a legalduty of ship masters however, there should be a logic and legal method forcompensating the damages. This job is carried out either for the purpose of aneconomic interest or it is done morally on the basis of beneficence.
