موجه ، مستند و مستدل بودن رای دادگاه و داوری

رای مستدل رایی است که دادرس و داور کلیه جوانب عمل و واقعه حقوقی را شناسایی، تحلیل و توصیف نماید. منظور از رای مستند پیدا کردن قالب قانونی برای واقعه یا عمل حقوقی صورت گرفته است. موجه با مستدل بودن رای مفهومی یکسان دارد لیکن با مدلل بودن متفاوت است. توصیف تکنیک حقوقی است که امور موضوعی را به امور حکمی متصل می کند. دادرس برای صدور رای ابتدا منشا خواسته خواهان را بررسی و با کشف حقیقت عمل و واقعه حقوقی را توصیف می کند و نهایتاً قالب قانونی آن را انتخاب و بر اساس آن حکم مسئله را جاری و رای پرونده را صادر می کند. این تحقیق به نقش، جایگاه و تاثیر رای مستدل، مستند و موجه در تامین عدالت قضایی و حقوق طرفین و ضمانت اجرای عدم رعایت این عوامل که حسب مورد ناظر بر جبران خسارات وارده، تخلف انتظامی و ارتکاب جرم کیفری است می پردازد. از این رو ابتدا مفهوم و ماهیت مستدل، مستند، موجه بودن رای بررسی و تفاوت آن با توصیف حقوقی قضیه و آثار حاکم بر آن مشخص می گردد. نهایتاً ضمانت اجراهای عدم صدور رای غیرمستدل و غیر مستند تحلیل و بررسی می گردد.

Justification, documentation and reasoning of the court’s verdict and judging the guarantee of its execution

A reasoned opinion is a decision that a judge and an arbitrator identify, analyze and describe all aspects of the action and the legal event. The purpose of the documentary vote is to find a legal framework for the event or legal act. Justification has the same meaning as reasoning, but it is different from reasoning. Description is a legal technique that connects subject matter to judgment. In order to issue a verdict, the judge first examines the origin of the plaintiff’s request and, by discovering the truth, describes the act and the legal event, and finally selects its legal form, and based on that, fulfill the sentence and issues the verdict. This research deals with the role, position and effect of reasoned, documented and justified opinion in ensuring judicial justice and the rights of the parties and guaranteeing the nonobservance of these factors, which, as the case may be, is related to compensation for the damages, disciplinary violations and criminal offenses. Therefore, first, the concept and nature of reasoning, documentary, justification of the verdict, its examination and difference with the legal description of the case, and its effects are determined.
