کارکرد بلاک چین در حمایت از کپی‌رایت

بلاک چین بستری نامتمرکز است که قابلیت برخورداری از انواع تراکنش‌های مالی و ذخیره داده‌پیام‌های الکترونیکی را دارد. این پژوهش به روش اسنادی به دنبال پاسخگویی به این سوال است که پیاده‌سازی بلاک چین چه نقشی در حمایت از کپی‌رایت در سطح بین‌الملل دارد؟ مهم‌ترین نقش این بستر در ایجاد امنیت، شفافیت، در دسترس بودن کاربران، پیشگیری از نقض حقوق فکری و حمایت بیشتر و سریع‌تر کشورهای پیاده‌سازی کننده این بستر از حقوق کپی‌رایت افراد خلاصه می‌شود؛ اما شناسایی این شاخصه‏ها منوط به مفهوم شناسی، بیان کارکرد، وجوه تمایز و چالش‌های فراروی این بستر است. به جهت گسترده بودن این بستر در جهان، عرضه و انتشار یک اثر به‌منزله انتشار آن بوده و تمامی کشورهای دربردارنده آن‌که ملحق به کنوانسیون برن می‌باشند، ملزم به حمایت از این اثر هستند، البته پیاده‌سازی بلاک چین با چالش‌هایی همچون امنیت مبادلاتی، هماهنگی فضای داخل و خارج بلاک چین، فقدان قوانین در جهت هماهنگ‌سازی قراردادهای اعطای مجوز، ذخیره‌سازی ابر داده‌ها و تغییرناپذیری همراه است که نیازمند توجه سیاست‌گذاران در پیاده‌سازی این بستر در نظام حقوقی است.

But the identification of these indicators depends on the conceptualization, the expression of the function, the means of differentiation, and the challenges faced by this context. Of course, block chain’s implementation is faced with challenges such as security of trade, the coordination of the inside and outside of it, and the lack of rules for the harmonization of licensing contracts, virtual currency validation, metadata storage and invariance, which requires the attention of policymakers in Implementation of this ledger in the legal system.
