تحلیل نظری بزهدیدگی جنسی کودکان (مطالعه موردی بزهدیدگی فرشته کوچک مغان)

زمینه و هدف: در قتلهای جنسی، در صورتی‌که قربانی کودک بوده و بعد از آزار جنسی قربانی شود، بیش از هر جرم دیگری احساسات جمعی جریحه‌دار می‌شود. هدف پژوهش حاضر، بررسی و تحلیل جرم‌شناختی بزهدیدگی‌جنسی کودکان بود.روش: باتوجه به ماهیت موضوع، پژوهش از نظر هدف کاربردی و به‌لحاظ گردآوری اطلاعات به‌روش اسنادی و از طریق مطالعه پرونده قضایی انجام شده و اطلاعات تحصیلی به‌صورت توصیفی-تحلیلی مورد تحریر قرار گرفته است.یافته‌ها: باتوجه به فرآیند وقوع قتل جنسی و نحوه قربانی‌شدن بزهدیده، می‌توان بزهدیدگی وی را با نظریات جرم‌شناسی همچون نظریات فرصت، همجواری، فعالیتهای روزمره، سبک‌زندگی و شتاب‌دهندگی بزهدیده مورد تحلیل قرار داد. نتیجه‌گیری: با جمع‌بندی نظریات «جرم شناسی فرصت، همجواری، فعالیتهای روزمره و سبک‌زندگی» می‌توان گفت موضوع بزهدیدگی‌جنسی منجر به قتل قربانی با نظریه شتاب‌دهندگی بزهدیده نیز قابلیت هم‌سنجشی دارد. براین اساس؛ موقعیت و ماهیت رفتار قربانی و اطرافیانش در فرآیند ارتکاب جرم توسط بزهکار تاثیرگذار بوده است؛ زیرا موقعیت، سبک و شیوه زندگی قربانی و خانواده‌اش باعث انگیزه‌مند شدن بزهکار برای گرایش به ارتکاب قتل جنسی، شده است. آنچه که محرز و مسلم است، آتنا هیچ نقش فعال و منفعلی در بزهدیدگی خویش نداشته و غفلت و مسامحه والدین، مدرسه و نهادهای آموزشی در ارائه آموزشهای لازم و کافی به قربانی به‌عنوان کودک در معرض خطر به‌خصوص که در شرایط نامناسب اجتماعی-اقتصادی زندگی می‌کرده است؛ از مهمترین علل بزهدیدگی‌ او بوده است.

theoretical analysis of sexual victimization of children(case study: the victimization of little angel of moghān)

background and aim: in sexual homicides, if the victim is a child and is subjected to sexual abuse before being killed, it triggers collective emotions more than any other crime. the aim of this study is to examine and analyze the criminological aspects of sexual victimization of children. method: considering the nature of the topic, this research is applied in terms of objectives and has been conducted through documentary methods, studying a judicial case, with descriptive and analytical reporting of educational information. results: based on the process of sexual homicide and the manner in which the victim is targeted, the victimization can be analyzed using criminological theories such as opportunity theories, adjacency, routine activities, lifestyle, and victim facilitation. conclusion: by summarizing the theories of opportunity criminology, adjacency, routine activities, and lifestyle, it can be said that the issue of sexual victimization leading to the victim's murder also aligns with the theory of victim facilitation. accordingly, the situation and nature of the victim's behavior and their surroundings influenced the commission of the crime by the perpetrator. the victim played no active or passive role in their own victimization, and the negligence of parents, schools, and educational institutions in providing the necessary and sufficient training to the victim (especially as a child at risk, particularly living in unfavorable socio-economic conditions) has been one of the most important causes of their victimization.
