بازخوانی و تحلیل مفهوم استقلال مالی زوجه در پارادایم اسلام

زمینه و هدف: پارادایم اسلام در موضوع زنان و حقوق آنان زمینۀ تغییرات بنیادی بسیاری را در نظام حقوقی جهان اسلام نسبت به زنان فراهم‌آورد؛ مساله استقلال مالی زوجه یکی از زیر مجموعه‌های چالش برانگیز این پارادایم است که ابهام در حدود آن آسیب های پرشماری را در حوزه‌های مختلف به همراه دارد. پژوهش حاضر با هدف بررسی بازخوانی و تحلیل مفهوم استقلال مالی زوجه در پارادایم اسلام، در صدد است گسترۀ استقلال مالی زوجه را مشخص‌سازد. روش: پژوهش حاضر تحلیلى است و با روش کتابخانه‌ای اجرا شده‌است، داده‌هاى پژوهش با بررسى اسنادى، جمع آوری و با رویکرد استدلالی، تحلیل شده‌اند. قرآن و روایات به عنوان جامعة تحقیق و نظرات ناظر به اهداف پژوهش فقهاء، به عنوان مبانی تبیینی پژوهش مورد استفاده قرارگرفته‌است. یافته‌ها: حاکی از آن است که برخی فقهاء گسترۀ استفادۀ زنان از اموال خصوصی خود را مقید به مولفه‌های مقدماتی مالکیت می‌دانند لکن پس از تحقق مقدمات، مالکیت لا بشرط و مطلق است. گروه دوم از فقهاء معتقدند به دلالت التزامی تصرّفات زنان بر اموال خویش پس مالکیت مطلق نبوده و نسبی است. نتیجه: با تحلیل استدلالی مبانی دو گروه مبرهن گردید که استقلال مالی زوجه در مالکیت و تصرف در دین اسلام امری مسلم ‌است و زوجه می‌تواند بدون اجازه یا رضایت زوج هر نوع دخل و تصرف مشروعی که بخواهد در اموال خویش بنماید. لکن زوجه نباید با ابتنا بر این استقلال در وظایف قطعی زوجیت اهمال نماید بلکه به نحوی باید از استقلال مالی خویش بهره برد که حق اعضای خانواده خصوصا همسر تضییع نگردد.

rereading and analyzing the concept of wife’s financial independence in the paradigm of islam

context and purpose: the paradigm of islam in the issue of women and their rights provided the ground for many fundamental changes in the legal system of the islamic world regarding women; the issue of financial independence of the wife is one of the challenging subsets of this paradigm, the ambiguity of which brings many harms in various fields. the current research aims to review and analyze the concept of wife’s financial independence in the paradigm of islam, and aims to determine the scope of wife’s financial independence. method: the present research is analytical and has been carried out with the library method. the qur’an and hadiths as a research community and opinions related to the goals of the jurists’ research have been used as the explanatory bases of the research. findings: it indicates that some jurists consider the range of women’s use of their private property to be limited to the preliminary components of ownership, but after the fulfillment of the prerequisites, ownership is unconditional and absolute. the second group of jurists believe that women’s ownership of their property is not absolute but relative. result: the financial independence of the wife in property and possession is certain in the religion of islam, but the wife should not neglect the definite duties of marriage by relying on this independence.
