مصداق ابوالجهم در مشهورۀ قضایی ابی‌خدیجه

روایت مشهوره ابی‌خدیجه، از مهم‌ترین ادلّه، در دو بحث ولایت‌فقیه و قضاوت است و احکام زیادی در باب قضا از این روایت استفاده می شود. مشروعیت این احکام به صحت سند و توجه فقها به این روایت می باشد. سند این روایت، مشتمل بر شخصیتی با کنیه ابو‌الجهم است که این کنیه در آن طبقه حدیثی بر اساس نظرات کتاب های رجالی، تنها بر دو شخصیت، ثویر بن ابو‌فاخته و یا بکیر بن اعین منطبق می‌گردد. مشکل این نظریه فاصله میان راوی از ابوالجهم؛ یعنی حسین بن سعید الاهوازی با ابو‌الجهم است؛ زیرا حسین بن سعید بنا بر اقوال مختلف از اصحاب امامان کاظم، رضا، جواد و هادی علیهم‌السلام بوده است، درحالی‌که دو شخصیت ثویر بن ابی‌فاخته و بکیر بن اعین تا زمان امام صادق علیه‌السلام زیسته اند؛ از همین رو، برخی برای حل این مشکل به بیان واسطه های احتمالی حذف‌شده میان حسین بن سعید و ابو‌الجهم پرداخته اند. برخی نیز ابو‌الجهم را منحصر در این دو شخصیت نمی‌دانند؛ ‌ولی در مورد مصداقش به نتیجه مشخصی‌ نرسیده‌اند. این پژوهش با بهره‌گیری از اسناد روایات موجود در کتاب‌های روایی، سعی کرده کاستی‌های موجود در کتاب‌های رجالی را تا حدی جبران کند و ثابت نماید: هرچند این کنیه در آن طبقه حدیثی تنها بر این دو شخصیت منطبق می گردد؛ ولی در کتاب‌های روایی و اسناد برخی از روایات، برای شخصیت دیگری نیز استفاده گردیده و آن شخص، هارون بن الجهم است.

The Referent of Abu al-Jahm in the Famous Judgement Narration of Abi Khadijeh

The famous narration of Abi Khadijeh is among the most important evidence on welāyatefaqih and judgment, and many rulings in the field of judgement are based on this narration. The legitimacy of these rulings depends on the documentation authenticity of this narration and the attention the Islamic jurists have paid to it. The document of this narration includes a character with the kunyah Abu alJahm, which, according to rijāl sources, corresponds to only two characters, Thawir ibn Abu Fākhetah and Bokair ibn A #39;yan. The problem with this theory is the time interval between the narrator from Abu alJahm, i.e., Hussein ibn Sa rsquo;eed alAhwāzi, and Abu alJahm himself as Hussein ibn Sa rsquo;eed, according to various sources, was one of the companions of Imams Kāzem, Rezā, Javād and Hādi (a.s.) while Thawir ibn Abu Fākhetah and Bokair ibn A #39;yan lived until the time of Imam Sadiq (a.s.). To solve this problem, some scholars have suggested the possible eliminated intermediaries between Hussein ibn Sa rsquo;eed and Abu alJahm. Some others do not consider Abu alJahm to be exclusive to these two individuals, but they have not reached a definite conclusion about the referent of Abu alJahm. Using the documents of narrations in narration books, this study has tried to compensate for the shortcomings in rijāl books to some extent and has proved that although this kunyah in that hadith category corresponds only to these two characters, it has been used for another character in the books of narrations and documents of some narrations, as well, and that person is Harun ibn alJahm.
