نولیبرالیسم و تولد دوبارۀ سزاگرایی کیفری

این واقعیت که از اواخر قرن بیستم در آمریکا، آن ‌هم بعد از گذار از تئوری‌های مختلف در حوزه سیاست جنایی، دوباره نوبت به سزاگرایی، اعمال مجازات متناسب، سختگیرانه و توجه به‌ گونه‌ای از اخلاق اجتماعی و حفظ آن از طریق نظام سزادهی استحقاقی رسیده است، بسیار محل تامل و بحث است. برخی اندیشمندان توضیح این تحول را در تغییرات اساسی در رویکردهای مرتبط با حقوق کیفری و حتی برخی نظریه های اجتماعی و فرهنگی خلاصه می‌کنند. در نوشتار حاضر، نگارنده قصد دارد تا به مولفه‌های سیاسی تاثیرگذار بر بازتولید ادبیات سزادهی بپردازد. آنچه در پایان نتیجه گرفته خواهد شد، همسویی سزاگرایی و ارکان اصلیِ آن با خوانش جدید و مسلط از نظریۀ لیبرالیسم سیاسی است که با عنوانِ نولیبرالیسم به برخی ویژگی‌های مبنایی سزاگرایی بسیار نزدیک است.

NEOLIBERALISM AND THE REBIRTH OF RETRIBUTIVISM

The resurrection of neoretributivism in the American criminal justice system, with its ideology of proportional punishments, a harsh justice system, and maintenance of social ethics, in the last decades of the 20th century, is a subject that requires more explanation. Some thinkers attribute this phenomenon to basic changes in legal theories or cultural and social structures. But there have been few studies about the nature of political changes which can be operative in this new criminal policy trend. In this study, therefore, we try to clarify new inclinations in political philosophy that have been effective in the resurrection of this new criminal policy. Therefore, it can be concluded that changes in the structure of liberalism, which have led to the rise of neoliberalism, can well explain much more about the rise of the policies of neoretributivism during last decades of twentieth century.
