شناسایی عوامل موثر بر پیاده ‌سازی حقوق ورزشی مبتنی بر مسئولیت مدنی باشگاه‌ها‌‌ی ورزشی

هدف: این پژوهش با هدف شناسایی عوامل موثر بر پیاده‌سازی حقوق ورزشی مبتنی بر مسئولیت مدنی باشگاه‌ها انجام شد.روش‌شناسی: روش تحقیق از نوع مطالعه اکتشافی نظام‌مند با رویکرد تحلیل مضمون (تماتیک) استفاده شد. گردآوری داده‌ها به روش‌های متعددی مانند مصاحبه، مطالعه کتابخانه‌ای و بررسی اسناد انجام گرفت. بخش انسانی جامعه آماری شامل اساتید و پژوهشگران خبره دانشگاه‌ها (حقوق ورزشی، مدیریت ورزشی، حقوق، و..) و کارشناسان حقوقی در ورزش، مدیران باشگاه‌های ورزشی بود که مورد مصاحبه قرار گرفتند. نمونه‌گیری در بخش کیفی به روش نظری و از نوع قضاوتی (برمبنای معیارهایی مانند تخصص، رده شغلی، سابقه شغلی و ...) بود (17 نفر). روایی رونوشت مطالعه کتابخانه‌ای و ابزار مصاحبه ابتدا با استفاده از نظر متخصصان ارزیابی گردید. سپس از طریق روش‌های روایی کدگذاری و توافق مصححان (ضریب کاپا)، بررسی شد.یافته‌ها: نتایج نشان داد بسترها و زمینه‌ها (محیط حقوقی باشگاه‌داری ورزشی، سیستم حقوقی باشگاه‌داری ورزشی، مدیریت حقوقی باشگاه‌داری ورزشی و توسعه حقوقی باشگاه‌داری ورزشی عوامل موثر هستند.نتیجه‌گیری: با توجه به نتایج، توسعه محیط و سیستم حقوقی در باشگاه‌های ورزشی، و توجه به این شاخص‌ها باعث نهادینه شدن حقوق ورزشی مبتنی بر مسئولیت مدنی خواهد شد.

identifying the effective factors on the implementation of sports rights based on the civil liability of sport clubs

objective: the aim of this study was to identify the factors affecting the implementation of sports rights based on clubs’ civil liabilitymethodology: the research method was a systematic exploratory study with a thematic analysis approach. data were collected through several methods such as interviews, library study and document review. the statistical population of this section included two human resources and information resources (scientific resources, documentary and library resources). the human part of the statistical community includes university professors and researchers (sports law, sports management, law, etc.) and legal experts in sports, managers of sports clubs who were interviewed. qualitative sampling was theoretical and judgmental (based on criteria such as specialty, job category, work history, etc.) (17 participants). the validity of the library study transcript and interview tools was first assessed using expert opinion. then, through validation methods, coding and agreement of the correctors (kappa coefficient) were examined.results: findings showed that the contexts and contexts (legal environment of sports management, legal system of sports management, legal management of sports management and legal development of sports management are effective indicators.conclusion: according to the results, the development of the environment and legal system in sports clubs, and paying attention to these indicators will lead to the institutionalization of sports rights based on civil responsibility.
